  3. Do you think based on the current immigration reform or the overflow of ROW EB2 and EB1 that ROW EB3 will go past March 1, 2008 in the June bulletin? My priority date is February 15, 2008 and I've been desperately waiting for years for this to get to this point.

    1. The dates are based on applying FB spillovers to EB3 India. USCIS has not mentioned when they will apply the spillovers (it seems they may have already started).

  9. Do you think EB3-I will move two weeks again? Reason I asked was because it appears that there appears to be quite a few applications in the end of Dec/early Jan timeframe. Even with the spillovers applied...do you think it will still move at that pace?

    Also do you think the spillovers have already been applied to EB3I? Or do u think there's still some more the next few months?

  10. EB spillovers will be applied in the last quarter. USCIS has not mentioned anything about FB spillover application. We expect them to apply it slowly every month.

    1. At the current rate, it could take a very long time to reach that date. Most of the H1 visas are issued to top Indian consulting firms (Tata, Cognizant, Wipro, etc). Hence demand from India applicants continues to remain high.

      In addition around 300 people are CURRENTLY porting every month from EB3 India to Eb2 India - and using ALL available quota of EB2 India. It is likely that as EB2 India dates moves ahead, the EB3 to EB2 porting rate could stay the same or increase.

  13. I have followed EB2I 2013 predictions on your website , trackkit forums and few other sites. In all of the predictions most consistent view is that either EB2I dates will reach end of 2007 or early 2008 depending on porting and spillovers by Sep 2013.
    Assuming we have 1000 porting cases from April 13 to Sep 13 do you think dates for EB2I might reach early 2008.

    1. We will be adding a post on how far EB2 India and other categories could go due to EB and FB spillovers in the last quarter.

      Currently the porting rate is around 300 per month or 2100 for the seven months (Apr to Sept). The unknown factors are demand in other EB1, EB4 and EB5 categories (which affects spillovers). Also the demand in EB2 India between Aug 2007 and Feb 2008 is currently unknown. Hope this gives you a little idea :)

    1. It is between generous and conservative. We are expecting EB3ROW to move between 4 to 6 months in the June 2013 VB.

      EB3 China and EB3 Mexico would have the same cutoff date as EB3ROW in June 2013 VB.

  23. Will the unused allocation Visa for EB1, EB2, EB4 & EB5 will go to EB3 for a particular country (like Philippines) or it will be absorbed in another country? How about the rule on per country limit, how will these affect the unused Visa allocation? Thank you so much for taking time on this one... More power to you.

    1. The rules for EB and FB spillovers are different. I am assuming your question is only about EB spillovers.

      EB spillovers flow: EB4 + EB5 --> EB1 --> EB2 --> EB3

      If EB2 is retrogressed, all spillovers would be consumed by EB2 category.

      In case there is spillover to EB3 (which will happen only when EB2 all countries are current), then the country with the most retrogressed date would get all spillovers till its date is same as the next retrogressed country.

      In EB3, EB3 India would first get all spillovers until EB3 India date is same as EB3 Philippines. Then they would equally share the spillovers till its date reaches EB3 Mexico. Hope this helps.

    2. Thank you so much for the reply. You were right, what I meant is for EB spillovers. However, in follow up to above question and your related answers in the last two paragraphs, can you enlighten me more why PD EB3 Philippines was overtaken by China? In June 2012 VB, EB3 China PD was Aug 2005 while Philippines was May 2006. However, in May 2013 VB, China is already Dec 2007, while Philippines is Sep 2006? Why is it that Philippines EB3 did not level with China, considering the above explanations? Will the absorption of spillovers to India not in violation to per country limit?

      Can you also recommend me a Law Firm who is better to handle EB3 porting to EB2? I have a Master's Degree in Chemistry with units in PhD Chem and I am teaching in high school. I have I-140 with EB3 PD Jan 2009. With India's pending and Philippines slow movement, I am very anxious, since I have dependents who will probably turn 21, and will be out of status, if I can not get my Green Card in timely manner.

      A. Visa bulletin movements depends directly on the demand (how many people are filing I-485 application). The demand from EB3 Philippines is a LOT higher than EB3 China.

      Q. Will the absorption of spillovers to India not in violation to per country limit?
      A. The per country limit applies at initial stage only: (a) when establishing visa bulletin cutoff date and (b) spillover from FB to EB categories. Per country limit does not apply to EB spillovers.

      Q. Can you also recommend me a Law Firm who is better to handle EB3 porting to EB2?
      A. The law firm which filed your EB3 case would be a good resource to file EB2 application - since they have already reviewed your case completely. Let me know if you are still looking for another law firm.

    1. Hi anonymous, we are waiting for USCIS to update the I-485 pending inventory to get more accurate data. Till then we are expecting EB3 ROW to move by around 4 months in June VB. If demand is low, it could be 6 months.

    1. We are waiting for USCIS to release updated I-485 pending inventory. The current data is around 4 months old.

      We have a good idea on what will be in demand data. So that document would not help as much as I-485 pending inventory.

      Apart from blog, we are also working on 4-5 new features/functionality. These should be out soon :)

      If demand is low between May 1 and May 9, then it could jump by 6 months.

    1. The April 2008 date listed above is prediction. We will post the official visa bulletin when DOS releases it around May 10.

      When your PD becomes current, you can file the I-485 application. The current processing time for I-485 is between 4-8 months.

  33. Good afternoon everyone! My PD is March 5th, 2008 - EB3 ROW (Canada). I hope the predictions above are accurate. Apart from the i-485 processing times (4-7 months) do I need to be concerned with the 7% allocation per country after my priority date becomes current? i.e. Does the ROW per country demand influence GC availability beyond the basic category dates? For how long will EAD be issued initially?

    1. 7% allocation would not apply during I-485 processing. It is used to establish visa bulletin cutoff date.

      EAD is typically issued for either 1 or 2 years.

    My PD is Jul 28, 2008 EB3 ROW. My I-140 was done a couple of years ago. My questions are:
    1- When do you think my date will become current?
    2- Once my 485 is filed (Texas is my service center) how long would it take for me to get my AP and EAD and also how my time from filing of my 485 will it be get my green card?
    3- Do you expect that the PD will continue to move forward and retrogress once my PD (July 28 '08) becomes current and 485 is filed?
    4- Once I have my EAD... could I switch my jobs or would I have to wait until I have my my actual green card before switching over.

      4. Technically yes you can switch jobs using EAD. If you do not have EAD, then according to AC21 rule, you will have to wait for 180 days after I-485 application was filed.

    So as I will be out of the country all of June returning on Jul 11th. If my date becomes current as you said above in July VB (which I am assuming comes out after the 10th of June??).. and I come back on the 11 July have all my paperwork ready to file..I hope the date for the month stays current at least until the end of that month. So in my case if I filed on the 12th..and by chance the date retrogresses in Aug VB. Would my application be accepted as long as I filed it before Jul 31st?

    1. Hi Paulo, That is right. If the PD becomes current in July VB, you can file anytime between July 1 and July 31.

      If PD is still current in Aug VB, then you can also file anytime in August. If dates retrogress in August, they would still accept your application if they received it before August 1.

      Also be on lookout for June VB. In rare cases DOS moves dates to Aug 2008 in the June VB, you can file your application on June 1.

    Jun 2010 cut off date was Sep 2000
    Jan 2011 cut off date was Jan 2002
    Feb 2011 cut off date was Jan 2000...............Based on all of these can you predict visa availability for Aug 2002?

    1. Visa allocation is supply and demand. The supply is fixed at 140,000 per year (for all EB categories). The demand however is not fixed and changes daily.

      We are waiting for updated data from Visa Office. This will give an accurate demand. The current I-485 pending inventory is around 4 months old and only include demand till Aug 2007 for EB3 ROW (since dates did not move beyond that).

    1. There are many factors which affects visa bulletin movement. Currently the porting from EB3 India to EB2 is consuming the annual quota for EB2 India. The only way EB2 India can move is due to spillovers from EB and FB categories.

      Since demand changes every month in all categories (EB and FB), it directly affects the amount of spillover available. Hence we cannot estimate the movement that far.

    2. It is currently hard to give an estimate on that date. Due to heavy porting from EB3, dates may not continue to move forward every month.

      This is also evident from current EB2 India dates (which has not moved since last May).

      It should move forward in the last quarter of FY (July - Sept).

      EB3 Philippines currently have around 2200 applicants from Jan 2007 to July 2007.

      RFE can be issued anytime during I-485 processing. It really depends on the officer reviewing the case. Sometimes what is acceptable to one officer may not be acceptable to another officer.

      2. You can switch employer and start process again. You can retain your earlier PD if I-140 is approved.
