    3. Do you know alot of people became current in December visa bulletin? this is kind of bad news to me. I really think a retrogression is about to happen. (EB3ROW)

    4. I am one of these people. :) I don't think there will be a retrogression. As Amazon mentioned here - the demand is still low for EB3ROW, so the dates will keep moving forward for a month or so. Ones the demand is high again then we'll start to worry.

    9. That's normal that so many people became current because the dates moved so rapidly. That was the idea to keep things going and to generate demand. I don't think there will be a retrogression. The dates might stop moving in the near future, yes, but not retrogress. Oh well, my guess is no better than yours. :)

  2. Interesting that people with PD who are not current are processed by NVC with the simple difference that NVC looks at aqualifying date to process a petition than cut off date from VB. Qualifying date is beyond the cut off date from VB. For example, i know couple of members with a PD of Sep 10th or 11th, 2013 in the F2A category whose case is processed at NVC. But a person with Sep 26th, 2013 as PD is just sitting at NVC and he got the email and info that there are no visa numbers for his PD. Per December Bulletin cut off date is Sep 8th 2013. Looks like DOS informs NVC about the visa bulletin may be a month or two in advance and only way cases with PD of Sep 10th or Sep 11th, 2013 can be processed now even though they are beyond the cut off date in December VB is when NVC gets to know what could be the PD in coming months for a particular category which i believe they will know a month or two ahead.

    1. yes vijay u r right.NVC knows in advance. wat abt u. my case got approved on nov 7th PD is june 13 2013. NVC received case on dec 5th. How much time it will take 2 get case number and do all formalities. wat abt interview and medical any idea

    2. We got a case complete on Dec 5th. Waiting for Interview date.

      It takes 30 business days to get case number from NVC. I got it in 20 business days. Keep calling NVC.

    4. Meaning? We submitted all the docs on Nov 6th. NVC had the docs in their system on Nov 8th. got case complete on Dec 5th.

      Before that once you get your case number it takes

      1) 2 days for Invoice to show up
      2) 2-3 days for "PAID" to show up after you pay your AOS and IV bill
      3) 2-3 days for DS260 to show up.

      So give it about two weeks for things to start working once you get your case number.

      Here is the timeline.
      I-130 (California Service Center)
      Category: F2A (India)
      Priority Date: Sep 3rd, 2013
      2013-08-23: Married
      2013-08-30 : I-130 Sent
      2013-09-03: I-130 Received
      2013-09-05: NOA-1
      2013-09-11: NOA1 (Hard copy)
      2013-09-27: NOA2 approved (SMS and email from USCIS)
      2013-10-02: NOA2 (Hardcopy)

      NVC
      2013-10-15: NVC received the case.
      2013-10-21: Received Case number, IIN, Beneficiary number
      2013-10-24: Received AOS and IV visa fee invoice email and paid both.
      2013-10-26: AOS Fee status changed to PAID.
      2013-10-28: IV Fee status changed to PAID. DS-260 is available.
      2013-11-06: AOS Docs sent/IV Docs sent/DS-260 Submitted Online.
      2013-11-07: NVC received the docs in the morning(Based on Fedex tracking).
      2013-11-08: NVC confirmed that they received the docs.
      2013-12:05: Case complete
      Waiting for I/L

    5. Thanks Vijay i really appreicate your help. I have 1 last question if my wife is pregnent like she is in 4-5 month prgnent during her medical. does that effect her visa or anything. please advice me thank u so much

    7. Pregnancy doesn't affect anything. Make sure you let the X Ray tech know that she is pregnant so they use extra caution against radiation.

      The U.S. Centers for Disease Control and Prevention (CDC) requires that women who are pregnant and required to have a medical examination in connection with the issuance of a visa, and are examined in a country currently using the 2007 TB Technical Instructions must have a chest x-ray examination conducted. Pregnant women will have to provide the panel physician with consent to conduct the chest x-ray. For the health of the applicant and her unborn child, CDC instructs panel physicians and laboratories to provide abdominal and pelvic protection with double layer, wrap-around lead shields when they receive the chest radiographs. This requirement does not apply to countries using the 1991 TB Technical Instructions which allow for an exemption of the chest x-ray requirement for pregnant women. Pregnant applicants who do not wish to have the X-ray will be granted a temporary exemption when they provide written certification of pregnancy signed by their personal physician or obstetrician."

      PLEASE ANSWER ME, MY SPONSOR DID NOT RECEIVE THE QUISTIONAIRE AFTER PERM WAS SUBMITTED. WHAT SHOULD WE DO ?

    2. The questionnaire comes via email. It is an almost instantaneous notification once the perm is submitted.

      The email might be in the junk folder or spam folder depending on your companies email policies. Ask them to check the junk or spam folders.

      If your company does not respond to it in 1 week, then the confirmation process moves to the telephone and the DOL will attempt to verify the questions by calling the company and talking to the petitioner on the application.

      But that delays the process so try to find the email and ask your mail admin to search the archives if it was permanently deleted. You have some time before the permanently deleted emails are truly purged from the mail server.

    1. you will be eligible to apply starting 1/1/2014; so you will need to apply when you get back. you might want to get your medical, pictures, forms filled out and other items ready and packaged so when you get back it's ready to go.

  13. I have approved i140 with PD May 2011. I am planning to change my job now. I understand i need to do labor i140 once again which would take another year or so. This being the case, do you think that my PD can become current anytime in later half of 2014 or early 2015? Any advice if job change with my PD is good decision?

    1. It is quite a blessing, 1 and a half month of movement makes a lot of difference since f4 have been posting 5-6 week movement over the past few months. I'm almost there...PD is oct 2003 f2b category philippines.

  21. we received our interview appointment but one of my daughter will be turning 21 before the interview date (age-out).We have sent an email regarding this but until now there is no reply.The time frame now is limited,we only have 15 days for my daughter to age-out......

    1. A derivative child generally does not 'age-out' exactly on their 21st birthday. First, if you are in the U.S. and filing under a sponsored preference category, then the time the primary beneficiary's I-130 / I-140 petition was being processed by the USCIS is added to the child's age. For example, if an I-130 / I-140 took 6 months between the receipt date and the approval date, then that time (6 months) is added to the derivate child's age before they 'age-out'. Second, if the derivate child has filed an I-485 adjustment of status application, then their age 'freezes' on the receipt date.

    2. In relation to a derivative child who will age-out at 21, can we file her I-485 even if our PD is not current yet? Let us say 1 more year or 6 months before our estimated PD comes in?

    3. No you cannot. A derivate I-485 adjustment of status application can ONLY be filed when the primary beneficiary's priority date is current and the primary beneficiary is filing at the same time or has filed their I-485 adjustment of status application.

      If you try to file an I-485 adjustment of status application when the associated priority date is not current, then it will be immediately rejected and you will lose your filing fees.

  22. we were affected by retrogression, last 2010 i was notified by the uscis to file and submit all the documents required..i did sent them all the docs but came the retrogression for F4 category.I waited for almost 3 years,then last Nov.30,2013 i received the interview appointment.one of my child will turn 21 before the sched.appointment interview.i also sent an email to the NVC about this matter but no reply yet.Can anybody advice me what to do?

      Anonymous 2 - which PD, and preference? Sometimes if the demand is much higher than normal, it cannot always estimate this (since USCIS generally release date every 30 - 45 days).

  24. hello guys! would anyone know how USCIS Processing Time is based on? Does it start or based from the PD or at the time an application was TRANSFERRED to the USCIS Field Office?

    I am in the F2A category (Philippines) and filed concurrently (I-130/I-485). PD was Aug. 19, 2013. Interview was on Nov.19, 2013 and just WAITING for decision now.
