USCIS FB I-485 & I-130 Processing Statistics As Of 10/31/13


Please see below latest FB (family based) statistics released by USCIS:

The applications at CSC is much lower than VSC in nearly all categories.

New receipts: USCIS have recently received application
Pending: USCIS have started processing application
Customer action waiting: USCIS is waiting for more document(s) from customer (RFE)
Preadjudicated: USCIS have finished processing the case but visa number is not available
Completed: USCIS have completed processing application

If you are planning to file I-130 or I-485 application, the table above will give you an idea of how many applicants are ahead of you.

Since USCIS goes by last receipt date, if you are going to file your I-485 (or just filed), you will be placed behind this queue. Exception is if application is preadjudicated then it would go by PD.

  1. Preadjudicated: USCIS have finished processing the case but visa number is not available

    I was under the impression that you cannot file form I-485 unless your priority date is current? If this is true, how can you have a category for "preadjudicated"? Is it possible to file i485 before PD is current?

A preadjudicated I-485 adjustment of status (AoS) application happens when a person's priority date becomes current, they file their I-485 AoS application, and before the USCIS starts adjudication of the I-485 AoS application and requests a visa number from the Department of State (DoS)* the cut off date (published in the DoS Visa Bulletin) regresses and the beneficiary's priority date is no longer current. Then at some point the USCIS will preadjudicate the I-485 AoS application while waiting for the beneficiary's priority date to become current again.

      * The I-485 AoS application receipt date is not the same as when the USCIS starts adjudication and requests a visa number. Thus resulting in cases where an I-485 AoS application has been filed and has a receipt date, but cannot get a visa number and be adjudicated because of cut off date regression. The cut off date published in the DoS Visa Bulletin only allows for filing of an I-485 AoS application. It does not guarantee or otherwise mean that a visa number will actually be available.
