USCIS Started Issuing Lots of RFE For I-485 Applicants

USCIS has started issuing hundreds or thousands of RFE on pending I-485 applications. However this time, the RFE is lot more accurate and does not ask for work authorization of dependents.

Majority of these RFE are for EB2 India applicants and from Texas Service Center. The latest RFE is asking for following document(s):

1. Proof of continuous employment authorization in the U.S. from the date the I-485 application was filed to the date of the RFE.
(2) Latest employment verification letter from the original sponsoring employer or, in cases of AC21 porting to a new employer, from the new employer.
(3) Updated I-693 medical exam form.

1. Continuous Employment: 

USCIS wants proof that applicant who submitted I-485 application either has EAD or valid H1 approval notice. You can send either of these documents (as applicable) to show continuous employment.

2. Employment Verification Letter:

This letter should be in original company letterhead, with current date. It should clearly specify the salary, title and description of employment, minimum education/training required, and date when the employment started (or will begin).

3. I-693 Medical Form:

The I-693 form is generally valid for one year only. However in previous years, USCIS automatically extended the validity of these forms for many years. However they have not updated the policy this year. Hence the I-693 form is valid for one year only. Hence USCIS is requesting applicants to send latest copy of I-693 form.

Conclusion:

Since many of these RFE are for EB2 India applicants, there is a possibility that dates for EB2 India could move forward to 2008 in the July Visa Bulletin.

  3. PD Dec 2003 EB3 India. I had a RFE issued on 4/19/14. Responded to it 5/19/14 for I-693, and employment Verification. Second RFE issue 6/3/14 still waiting to find out what its requesting.

    1. An immigration law firm / lawyers trolling for clients on someone else's immigration web site / blog is low class, if not disreputable. No one should sign up with a law firm such as this one, which has such practices. I wouldn't trust them with my immigration matters, filings, case.

  9. Hi! I applied i485 base on employment September 13,2013 and I am under additional review. my document is nothing wrong and I sent them everything what they wanted. I requested service and I got message I would have some response within 30days. However, I have not gotten any response. I have kept my H-1b. could you give me some ideas

  11. I received RFE for both me and my wife. I am the primary applicant. But they ask my wife for letter of employment too. How do I respond to this?? Thanks.

  12. All those who are receiving RFE for your I-485 applications (especially EB2 India applicants due to recent movement) please understand that RFE is not issued PURELY based on priority date but the important factor is your receipt date on your application.

    Example: PD 2008 applicant who filed in 2013 may not receive an RFE yet but PD 2009 applicant who filed in 2012 receives RFE.

    Reason: USCIS looks at the application packet based on Receipt date for those applicants whose priority date is/ will be current.

    1. Thats not the case. I have been tracking 100s of RFEs in trackitt. This pattern is not true. There is no pattern. It's random. Unfathomable.

  13. my case is with Nebraska Service Center and I got the RFE for the EVL/AC21 and medical. My old lawyer sent me the scanned copy of the RFE. Can some body let me know which address the RFE is to be replied to ? I will appreciate your help in this regard

  14. I received a similar RFE sometime back. I am EB3 India PD around Dec 2003. I am dependent on my spouse though she got her GC before the EB3 regression. So do I need to send just the 693 or employment info as well? If employment info then for me or my spouse (primary applicant)?

  16. I got a text and email from USCIS and when I checked the status this is what it showed. I filed on EB3 2006. So far haven't received any mail. I took an appointment for Tuesday on Infopass to see what my position is?
