If you have not done it, please remember to add or update your I-130/NVC/I-140/I-485 case in the GC tracker: http://www.mygcvisa.com/ tracker/

It would be very useful to understand how USCIS is currently processing cases. It would also help in estimating date movements in future VB.

We will update this table as we get more data. If you are interested, the dates above are based on following data:
  • Latest I-130/I-140/I-485 Processing Statistics (see link on right side) -->

Similar to EB3 category movement, we have added a blog post for EB2 category forward movement. Please click here for FB category.

Next Steps: If priority date is current and

1. If applicant is inside US, they will have to file I-485: http://blog.mygcvisa.com/2013/04/how-to-file-i-485-application.html

2. If applicant is outside US, it will be sent to NVC: http://blog.mygcvisa.com/2013/09/nvc-consular-processing-steps.html

    6. This is freaking frustrating. Last year at the same time the quota was current and first of all why the hell they made it current in Aug 2013 if they haven't given visas for people with priority dates prior to Aug 2013 for gods sake ? They make it current whenever they wanted no matter if people get the visa or not ? What the hell is the benefit of being in current status if half of the people couldn't get visa last year when it was current status. They have put F2A on hold for almost an year just to increase the demand. When demand increased they retrogressed. That sounds ridiculous. Why don't they start giving visas to F2A visas for 2014 quota and move it forward to Jan 2014 in october at least. Why do they want to keep visas on hold if they had more than 10k unapplied visas last year?

I was pleasantly surprised that a visa was probably reserved for me! But passport was returned after the embassy received it and with a letter that visa can not be issued as PD not current! So frustrated!
But PD is about to become current again, already submitted the passport. Hopefully visa will be issued soon.

    6. The Second Preference F2A Category

Each year, the Department of State allocates 115,000 visas under the Second Preference Category.  This preference category is currently experiencing a backlog of about 700,000, as indicated by the Migration Policy Institute’s testimony.  The data is derived from the Department of State’s National Visa Center and excludes filings that are sent to the USCIS, which is believed to be a much larger number. The Migration Policy Institute has been conducting migration studies from around the world for years, looking at each country’s immigration policy and how “nimble” those policies are to migration issues.  In comparison to other countries, the extended waiting periods imposed on LPRs and their nuclear families in the U.S. is “unique.”  [That’s certainly putting it lightly.] Most importantly, it is precisely these long waiting periods that incentivize individuals to break U.S. immigration laws.  In fact, Ranking Member Zoe Lofgren (D-CA) asked what the country had to gain by separating wives and husbands and parents from their children.  Mr. Papademetriou commented that, “Separating spouses and children is unnatural.”

  30. The
U.S. Senate finally releases its version of a Comprehensive Immigration Reform
    (CIR) bill today.  The Border
Security, Economic Opportunity, and Immigration Modernization Act of 2013 proposes
to reform many aspects of the current immigration policy, including the
creation of a new Registered Provisional Immigrant Status (RPI) for the
undocumented immigrants. The prerequisite is that the border must be secured
first before any RPI petition will be approved. The following are the
highlights of the most important proposed changes:

    Family-sponsored Immigration

Reduce the current four family preference categories
    to two categories only: Unmarried adult children (of U.S. citizens);
married adult children (of U.S. citizens) who file before age 31, and
unmarried adult children of lawful permanent residents.

Lawful permanent residents will be able to petition
for their spouses and minor children (currently F2A) without regard to
visa numbers – just like U.S. citizens can do now.

The current F4 preference category will be
eliminated 18 months after the law is enacted – meaning that U.S. citizens
will no longer be able to petition for their brothers and sisters.

  31. MAJOR CHANGES IN FAMILY IMMIGRATION PROPOSED IN SENATE BILLBy Reuben S. SeguritanMay 01, 2013

In line with its goal of shifting the focus of immigration from family-based to skills-based, the Senate comprehensive reform bill proposes a number of major changes in the current family-based preference system.

The annual limit of family-based immigrant visas will be reduced from 226,000 to 161,000. The per country cap will rise from 7% to 15%.

The bill will eliminate the 4th preference category for brothers and sisters of U.S. citizens and limit the 3rd preference category to married sons and daughters who are under 31. The changes will take effect after the bill is passed so that petitions filed before that will continue to be processed. U.S. citizens should consider filing their petitions for these relatives now.

Under the current system, the 4th preference category is allocated 65,000 annual visa numbers. As of November 2012, the Department of State recorded 2,873,114 applicants, including 188,521 Filipinos, on the waiting list.

The 3rd preference category on the other hand with current annual allocation of 23,400 has a waiting list of over 830,000 applicants. The bill will allocate 25% of the worldwide level for this scaled-back category.

The first preference category for the unmarried sons and daughters of U.S. citizens will be retained. This category has a waiting list of 288,000 and has an annual allocation of 23,400. Under the bill, it will have 35% of the worldwide allotment.

Unmarried sons and daughters of lawful permanent residents who are classified under the F2B preference category will be allocated 40% of the worldwide level.

Spouses and children of lawful permanent residents currently under the F2A category will be upgraded to the immediate relative category and would not therefore be subject to visa number limitation. Under that category they would be allowed to adjust their status even if they have overstayed or worked without authorization. Under the current system, only the spouse, unmarried children and parents of U.S. citizens have this benefit.

Derivative beneficiaries of immediate relatives applying for green card will be allowed to immigrate with their parents unlike now where they have to be petitioned separately under a different category. This will prevent separation of the children from their parents.

The bill will also benefit the unmarried sons and daughters of U.S. citizens under 31 and unmarried adult sons and daughters of lawful permanent residents who are beneficiaries of approved family-based petitions. They will be eligible for V visas to enable them to live and work in the U.S. while waiting for their priority dates to become current.

Brothers and sisters of U.S. citizens and sons and daughters of U.S. citizens over 31 years will also be eligible but they will not be authorized to work and their admission may not exceed 60 days per year.

Other new provisions under the bill include raising the age of a stepchild from 18 to 21 for purposes of allowing sponsorship by the stepparent; raising the age requirement for adopted child from 16 to 18; allowing aged-out children to retain the priority dates of the original petition of their parents; and permitting lawful permanent residents to file for a fiance petition.

The current rules pertaining to termination or reinstatement of registration for an immigrant visa, retention of priority dates, automatic conversion of visa petitions, petition for orphans and widows and inadmissibility waivers will be modified.

  34. For those making 'predictions' about the movement of this visa category or that visa category -- they are WAGs at best and should not be relied upon.

Amazon's (whose runs this blog and forum) predictions are grounded in careful and thoughtful estimations, and s/he has proven to be better than most in estimating cut off dates in the DoS Visa Bulletin. That being said, the one source that can be relied upon is Mr. Charles Oppenheim, Chief of the Visa Control and Reporting Division at the DoS, who is the person responsible for the monthly and annual visa number allocations and cut off dates.

Regarding the posted information on the Senate comprehensive immigration reform bill -- read the news -- this bill will NOT be taken up by the House and will die with the fall federal elections. There will be NO comprehensive immigration reform legislation out of the current Congress. Learn the facts before posting information.

  37. Expectations are high that President Obama can move ahead with controversial executive actions now that he has returned from his vacation.

Obama’s two weeks on Martha’s Vineyard, Mass., were plagued by dual crises, in Iraq and in Ferguson, Mo. But his break was also something of a blackout period for news about actions the White House is weighing on immigration reform and so-called corporate “inversions,” a business maneuver companies use to reduce their tax burdens.

Obama will be in Washington for just one full week before departing on a trip to Estonia and Wales in early September to reassure NATO allies amid conflict with Russia.

Obama announced in June that he would take action on immigration “before the end of summer.”

Kamal Essaheb, an attorney at the National Immigration Law Center, pointed to Obama’s June remarks, saying the president promised to make policy consistent with American values, and “we expect him to do that when he’s back from vacation.”

“People are waiting every day to see if the president’s going to make an announcement,”

    7. Fair enough. As of now the October visa bulletin is predicted to move up to Feb 08 2013 and you qualify for it as your priority date is Jan 30 2013. :)

  48. My comment was to the persons saying the cyt off date will move a year. Don't get me wrong, i would love for it to be true, however, the comments seem to be made to stir people up. My pd is aug 2013, completed interview since may of this year and was approved then told no numbers. Imagine my disappointment and frustration. All the best to everyone.

  49. Waiting time for F2A is killing, they should not divide the spouses, they must understand, they should make this category current forever, everyone has the right to stay with his family.....

  50. In addition to that, I just found out the medical rxpires after six months and even if you were approved, if your date does not become current in the six months, you have to go back to the consulate and redo the medical. I think they are downright insensitive and mean. Unnecessarily.

  51. I think according to new rules medical check up is valid upto 1 yr so take advice before you redo medical check up..!!

  53. Hello Guys I see some useful information about F2A category.
I am a LPR and I applied I-130 for my son under 21. the application was received September 30, 2013. I already received a letter with the case number but Haven't receive an approval from USCIS. It's been too long now 12 months. I send a status request they said it is pending in Vermont Service Center. I was thinking once USCIS approve a case it suppose to be sent to NVC and wait until visa availaible. does anyone is in the same case than me. thank you

    1. Hi, my PD is the same as yours 30 Sep 2013 and I received the approved from USCIS in march 2014. But my application it was for my husband and I never received a letter from NVC. I don't know why is taking long for you from USCIS. but I wish you good luck.

  57. My question is this in the birth certificate of my. Husband as the principal applicant his name has no suffix like Jr. But in our marriage contract and in the birth certificate of our son the Jr.was written, but he is really the junior of his father. It was not indicated in his birth certificate when they regissstered.. Do we need to follow on what is in the bc of my husband ? Our papers is already done and we are just waiting for the appointment interview. Please advice me to what will going to do.thanks

    1. In your son's birth certificate, your husband's name has Jr.?
The question was not too clear. And if everything is cleared, and you are just waiting for Interview, there is nothing to worry about, until and unless the visa center asks you for anything specific.

      Thanks.
