I am surprised there is no streamline system for shipping indians here since we r basically swallowing tens of thousands indians each year and ALL of our spill overs headed into eb2I and eb3I. Ridiculous.

  12. 1. Change annual cap from 226,000 to 161,000. Following is the allocation: 
         a. Unmarried adult children of U.S. citizen: 35%
         b. Married adult children of U.S. citizen under age 31 at the time of filing: 25%
         c. Unmarried adult children of lawful permanent resident: 40% 

    Annual cap change from 226,000 to 161,000 is effective 18 months after date of enactment. Though the annual cap will decrease, overall the number of family based immigration visas issued will increase (because of  expanded definition of immediate relative).

    2. Expand V visa to to allow following individuals with an approved family petition (I-130) to live in the U.S:
        a. Unmarried adult children of permanent residents/U.S. citizen
        b. Married adult children of U.S. citizen under 31 years at time of filing the petition.

    3. No more visa for siblings (brothers/sisters) of U.S. citizens 18 months after enactment of CIR. Hence this will remove F4 category.

    4. Immediate Relative now include a child or spouse of an alien admitted for lawful permanent residence.

    5. Recapture unused visas from 1992 to 2013; effective first FY from the date when this bill becomes law 

    6. Increase per country cap from 7% to 15%.


    Following applicants are excluded from annual FB cap (they have unlimited visas):

    1. Spouses and minor children of permanent residents 

    2. Spouses and minor children of U.S. citizen 

    3. Parents of U.S. citizen 

    Note: If a U.S. citizen sponsors their parents, then they can also (indirectly) sponsor their minor sibling (brother/sister). This is because the minor sibling would be considered derivative beneficiary of parents and hence would be able to immigrate with them.

    Keep families together.

    The proposal seeks to eliminate existing backlogs in the family-sponsored immigration system by recapturing unused visas and temporarily increasing annual visa numbers. The proposal also raises existing annual country caps from 7 percent to 15 percent for the family-sponsored immigration system. It also treats same-sex families as families by giving U.S. citizens and lawful permanent residents the ability to seek a visa on the basis of a permanent relationship with a same-sex partner. The proposal also revises current unlawful presence bars and provides broader discretion to waive bars in cases of hardship.

    Cut red tape for employers.

    The proposal also eliminates the backlog for employment-sponsored immigration by eliminating annual country caps and adding additional visas to the system. Changing the law, to upgrade spouses of legal permanent residents to immediate relative status, allowing those spouses to adjust status to obtain a green card, is one of the lead proposals in the proposed comprehensive immigration reform law. It is proposed to eliminate the huge backlogs in the number of applicants waiting for the chance to adjust status, who have approved petitions but must wait for their date of petition to become "current", allowing them to adjust status to get a green card.

  28. What can President Obama actually do?

    The following are some practical changes the president can make without Congressional action:

    He can grant deferred action for parents of childhood arrivals. Under DACA (Deferred Action for Childhood Arrivals), children who came to the U.S. under the age of 16 and remain under 31 years of age as of June 15, 2012, among other requirements, are eligible for deferred action status — they can remain in the U.S. for two years and are eligible to work. This is not a pathway to citizenship, but allowing parents to also receive deferred action status will prevent families from being separated. If you have questions about DACA and its eligibility requirements, please contact our office.

    He can change the way certain deportation cases are handled, mandating that federal authorities use favorable prosecutorial discretion. He could also stop deportations of spouses and children of U.S. citizens with no criminal records.

    He can designate that those with Temporary Protected Status (TPS) are eligible to apply for permanent residence if they receive approval of their visa petitions. This is already available to citizens of certain countries where there is political turmoil or a natural disaster making it unsafe for them to return.

    He can grant the undocumented spouses and children of U.S. citizens “parole in place”, thereby permitting them to apply for lawful permanent residence without leaving the United States and face a three-or-ten-year bar for entering unlawfully.

    He can change the way family and employment-based immigrant visas are counted against the worldwide visa quota. Currently, each member of the family is counted against the quota, whereas the president could make EACH FAMILY UNIT considered as one visa regardless of how many individuals in the family. This would open up the number of available visas, keep families together, and help employers hire skilled workers in a more efficient way.

    He can extend practical training programs for all foreign graduates of U.S. universities. This was implemented in 2012 for immigrants who are skilled in the STEM fields (science, technology, engineering, mathematics) and it has helped U.S. employers benefit longer from the talent of these individuals. Many talented students are forced to leave the U.S. after graduating from college or if they are hired, immigration restrictions often make it difficult for them to stay. In the same vein, the president could also make it easier for professors/researchers/employers to prove to the government that their prospective employee is outstanding in his or her field and worthy of remaining in the U.S. Extending practical training to all foreign students would free up the professional H-1B work visa quota, which usually is filled after the first day these visas become available.

    The president can grant work permission to spouses of H-1B professionals and O-1 extraordinary workers, creating even more space for eligible foreign workers to fill the H-1B quota. If someone obtains an H-1B visa and has a spouse who also has professional aspirations, it makes sense that they be able to work rath

  29. PRESIDENT OBAMA EXPECTED TO ANNOUNCE EXECUTIVE ACTION PLAN IN THE COMING WEEK

    Recently some major changes occurred over the political landscape of our country. For the first time in eight years, the Republican Party has control of the Senate. For the remainder of President Obama’s term, the controlling party in both chambers of Congress will be Republican. If we draw correlating lines to the fate of overall Immigration Reform, the long, drawn out attempt from advocates and pro-reform politicians who have fought and demonstrated for sweeping change of a broken immigration system — Comprehensive Immigration Reform may be farther away than ever or Republicans may decide to finally come together and bring a bill, or a series of bills, to the President. There is no clear-cut indication of either/or.

    Fortunately, what Congress plans on doing no longer matters. With an issue as uncertain as Immigration Reform, one thing that appears certain is that President Obama will no longer wait for Congress.

    Since the midterm congressional elections, the President has said on various public platforms that he is “going to do what [he] can do through executive action.” Over the past few months, he has been convening with members of his administration and legal scholars to determine what exactly that entails. This plan should be announced before the end of the year.

    What are possible actions the president could take and who may be favorably affected?

    The president’s plan is expected to provide relief to millions of immigrants currently living in the country. The following is a rough estimation of the possible changes the president could make:

    Unauthorized Immigrants Who Are Married to US Citizens or Green Card Holders – Immigrants in the US with spouses who have either US citizenship or a green card could become eligible for legal resident status, granted permission to work, and have their immigration interviews in the US.

    Unauthorized Immigrants with US Citizen Children — Many families are being unnecessarily torn apart because of a system intent on deporting for the sake of deporting. Under current law, the parents of such children cannot apply for legal status until their child turns 21. The president could make these immigrants eligible for legal status right away.

    Other Unauthorized Immigrants with Children — This would help the families who have children in the US who are not citizens, but are under 21.

    The president could also provided relief for parents of DACA (Deferred Action for Childhood Arrivals). Since 2012, under certain eligibility requirements, immigrant children have been granted the ability to remain in the country and work. The parents of DACA recipients could receive similar opportunity.

    Certain Immigrants Waiting to Receive their Green Cards — Right now, there are thousands of immigrants who have legally entered the immigration system waiting as long as a decade for permanent residence. A broken immigration system has created long visa backlogs and left these immigrants in no-man’s-land as they wait. The president could reduce the long waiting lines for these people.

    In the next few weeks, the exact details will be announced. What exactly they are or who will be affected is still to be determined.

    Please follow closely to determine if you are eligible for relief and what the next steps will be once they are announced. In addition, our office will be holding seminars in various cities across the country to better explain how the executive action plan could impact you.   37. The Second Preference F2A Category

    Each year, the Department of State allocates 115,000 visas under the Second Preference Category.  This preference category is currently experiencing a backlog of about 700,000, as indicated by the Migration Policy Institute’s testimony.  The data is derived from the Department of State’s National Visa Center and excludes filings that are sent to the USCIS, which is believed to be a much larger number. The Migration Policy Institute has been conducting migration studies from around the world for years, looking at each country’s immigration policy and how “nimble” those policies are to migration issues.  In comparison to other countries, the extended waiting periods imposed on LPRs and their nuclear families in the U.S. is “unique.”  [That’s certainly putting it lightly.] Most importantly, it is precisely these long waiting periods that incentivize individuals to break U.S. immigration laws.  In fact, Ranking Member Zoe Lofgren (D-CA) asked what the country had to gain by separating wives and husbands and parents from their children.  Mr. Papademetriou commented that, “Separating spouses and children is unnatural.”

    Reducing the F2A Visa Backlog

    The American Families United testified on their goal to unite nuclear families in the U.S., be it spouses and children of U.S. citizens or legal permanent residents, mainly in reference to the F2A visa preference category.  Its desire is to have Congress fold the F2A category into the Immediate Relatives category, in order to eliminate any waiting period for spouses and children of legal permanent residents.  This recommendation was also favored by the Migration Policy Institute, and surprisingly, well-received by Representative Raul Labrador (R-ID). The current waiting period for those in this category are roughly two years but even longer for families in certain countries, like Mexico and the Philippines. The other alternative, recommended by the Migration Policy Institute, is to revise the “V” non-immigrant visa to allow for spouses and unmarried children of LPRs to come to the U.S. by removing certain provisions in that were written into the Legal Immigration Family Equity Act of 2000.

But sad to say it is not the reform that the president is planning to sign next week. Its about giving amnesty to the illegal immigrants. Preventing them from deportation. This news made me sad all day, bcoz like everyone I was really waiting for this coming week. There is an immigrant lawyer on fb that's been posting this updates about this I got curious so I asked him. I hope president will give us the reform not just for illegal immigrants. We have family too.

    May be in this week or possibly next week Mr. President going to take executive action on Immigration Reform, there is nothing to do with the Immigration Reform for families of Legal Immigrants..., Mr. President should think more abut legal immigrants than illegal immigrants, after the executive action 5 million undocumented illegal’s are going to getting Green Cards, and the families of legal immigrants who are divided with their spouses and children’s are suffering and waiting to stay together….

    F2A applicants and their families are suffering a lot, frustration is killing…, and this is not fare separating husband and wife for more than two years…

    Mr. President must consider F2A in his executive action and give relief to the families to stay together…

It also treats same-sex families as families by giving U.S. citizens and lawful permanent residents the ability to seek a visa on the basis of a permanent relationship with a same-sex partner. The proposal also revises current unlawful presence bars and provides broader discretion to waive bars in cases of hardship.

If he had to authority to increase F visa and H visa all by himself then why even make it go thru house and senate for so long. He may add something but focus wil not be F and H, I think. Atleast that's whats on the news - undocumented 5 million people

I think his mission is not really for F and H coz there is a system atleast even if it's crap. Plus these things don't change overnight. It will take a while even if he declares something. That's why its called the government and not private company. Sad but true. Haha
