H.R 213 and S.153: Immigration Bills Introduced in Congress

H.R. 213 - Fairness for High-Skilled Immigrants Act of 2015

Congressman Jason Chaffetz introduced in the House H.R. 213 bill on January 8, 2015.

This bill will amend the Immigration and Nationality Act to 

(a) eliminate the per-country numerical limitation for employment-based immigrants and 
(b) to increase the per-country numerical limitation for family-sponsored immigrants, and for other purposes.

Some of you may remember that this bill is same as bill HR 3012 which was passed in House but did not pass in Senate (because of Irish immigration added to this bill in Senate which was opposed by Senator Grassley).

The first part of the bill will help applicants from India and China; however it will adversely affect applicants from all other countries (since applicants from India and China will no longer be restricted to 7% of quota).

S. 153 - Immigration Innovation ("I-Squared") Act of 2015

Senator Orrin Hatch introduced in the Senate S.153 bill on January 13, 2015.

This bill will amend the Immigration and Nationality Act to 

(a) Increase H1B cap from current 65,000 to 115,000
(b) Foreign nationals with advanced STEM degree will be cap-exempt from both green card and H1B visas
(c) Allow work authorization for spouses of H1B visas
(d) Allow dual intent for F1 visa holder
(e) Dependents of EB applicant will be cap exempted. Currently they account for 55% of all immigrant visas allocated
(f) Allow grace period for foreign workers
(g) EB1 applicants will be cap-exempt and lots more.

    2. Oh...and wages will go down. That's the reason industry wants S.153 to pass. So they can use the glut of new workers to lower wages.

  6. It is nothing for US FAMILY. !!!
    All is for employers.
    We welcome all workers from all country and give them right to work,
    but is no place for US families.
    No visa for my children,because they are more than 21 and they must wait out of the US for visa 10 years!
    No body care. I can write a book how pain I had and I habe and I will habe during waiting for my children several many years.
    My American husband don't have children.
    We are waiting for my children.
    But in America my children are no children. They are aliens relative,no my children,they are sons and daughters like,because they are more than 21.
    Now they are 30.
    When they will get Visa they will be 40.
    I don't know who will employer them on this age.
    Then my husband will be 70.How he will help for them.
    We are old.
    How we will show high income for sponsoring if we will be on retired when visa will be available?
    So maybe never children in America?
    We are worry we will stay alone here.
    It is to long time to wait for our children.
    Family based immigration is at the very end.
    But who is creation our country if not US families?

      I understand everything ,many people on the boat and every body waiting.
      I'm just not sure how many people really waiting outside of our country,how many like we are patiently waiting.
      They have another legal visas during this waiting time.
      We believed the processing time will be shorter,no 8 years for Europe,but 2 years,same like 10 years ago.
      8 years is a lot for young people and a lot for us old people waiting for children.
      Families missing children,I mean sons and daughters.
      Thank you ,I very appreciate I can sponsoring my family,this is beautiful gift from our country to immigrants.
      Just this boat is so slow,takes many years to come to America.
      That was 100 years ago.
      Today we travel airplanes.
      We me and my husband looking for immigration news around 3 years every day.
      We believe something will change soon and we would not be alone .
