The Department of Homeland Security today posted a Federal Register notice on the termination of Temporary Protected Status for Haiti. After consulting with interagency partners, Secretary Noem concluded that Haiti no longer meets the statutory requirements for TPS. This decision was based on a review conducted by U.S. Citizenship and Immigration Services, input from relevant U.S. government agencies, and an analysis indicating that allowing Haitian nationals to remain temporarily in the United States is inconsistent with U.S. national interests.

Court Order on Partial Stay of DHS 2024 USCIS Fee Rule

On Nov. 12, 2025, the United States District Court for the District of Colorado issued a decision in Moody v. Noem, No. 24-cv-00762-CNS (D. Colo.), staying certain EB-5 related fees that were codified by DHS in the 2024 Fee Rule, which became effective April 1, 2024. The court determined that the EB-5 Reform and Integrity Act of 2022 precluded DHS from adjusting EB-5 program fees in the 2024 Fee Rule. DHS and USCIS believe the Court's decision is incorrect but are working to implement it.

On Oct. 30, 2025, the United States District Court for the District of Maryland issued an order in Asylum Seeker Advocacy Project v. United States Citizenship and Immigration Services, et al., SAG-25-03299 (D. Presidential Proclamation on Restriction on Entry of Certain Nonimmigrant Workers

On September 19, 2025, the President issued a Proclamation, Restriction on Entry of Certain Nonimmigrant Workers, an important initial step to reform the H-1B nonimmigrant visa program. Under the Proclamation, new H-1B petitions filed at or after 12:01 a.m. eastern daylight time on September 21, 2025 must be accompanied by an additional $100,000 payment as a condition of eligibility.

In accordance with section 1(c) of the Proclamation, for H-1B petitions subject to the Proclamation, petitioners must submit a copy of the proof of the payment from pay.gov or evidence of an exception from the fee from the Secretary of Homeland Security at the time of filing the H-1B petition. Petitions subject to the $100,000 payment that are filed without evidence of payment or the grant of an exception will be denied.

USCIS Implements New Immigration Parole Fee Required by H.R. 1

The Department of Homeland Security is publishing a Federal Register notice to implement a new immigration parole fee required by the H.R. 1 Reconciliation Bill. The fee is $1,000 for FY 2025 and is subject to annual adjustments for inflation. You must pay this fee when you are paroled into the United States, unless you qualify for an exception.

WASHINGTON— The Department of Homeland Security is announcing a final rule, effective Oct. 2, 2025, to streamline the filing process for certain temporary agricultural worker petitions.

The new rule allows U.S. Citizenship and Immigration Services to begin processing petitions for H-2A temporary agricultural workers while the Department of Labor reviews the requested employment to ensure it would not harm American workers.

USCIS Updates Guidance on Military Naturalization

We are issuing guidance to explain that uncharacterized discharges that occurred on or after Aug. 1, 2024, do not meet the requirement of a separation "under honorable conditions" for former alien service members to naturalize under Sections 328 and 329 of the Immigration and Nationality Act (INA).

We also announced we will no longer coordinate with U.S. Customs and Border Protection to perform naturalization interviews and oath ceremonies at ports of entry. Instead, alien veterans living outside the U.S. must seek visas or parole to enter the country for a naturalization interview.

Defendant staged armed robberies so that "victims" could apply for immigration benefits in exchange for thousands of dollars

BOSTON – U.S. Citizenship and Immigration Services provided valuable assistance to the investigation that led to an Indian national, residing in New York, pleading guilty to staging armed robberies in furtherance of a visa fraud conspiracy.

Citizen of India Unlawfully Living in West Virginia Pleads Guilty in Marriage Fraud Scheme

BECKLEY, W.Va. – U.S. Citizenship and Immigration Services provided valuable assistance to the investigation that led to a citizen of India pleading guilty in a marriage fraud scheme.

The U.S. Attorney's Office anounced Aakash Prakash Makwana, 29, a citizen of India unlawfully residing in Ronceverte, West Virginia, pleaded guilty to aggravated identity theft. Makwana admitted that he committed the offense as part of a scheme to marry a U.S. citizen to evade U.S. immigration laws.

According to court documents and statements made in court, Makwana arrived in the U.S. on a J-1 nonimmigrant visa on Nov. 23, 2019. As part of his guilty plea, Makwana admitted that he knew the

Maryland Man Sentenced to Federal Prison for Visa Fraud

BALTIMORE – U.S. Citizenship and Immigration Services provided valuable assistance to the investigation that led to the sentencing of a Maryland man for visa fraud. U.S. Attorney for the District of Maryland Kelly O. Hayes announced the sentencing of Douglas Anthony Eze, 55, of Upper Marlboro, Maryland, to one year and one day in federal prison, followed by three years of supervised release, for visa fraud. Eze was also fined $20,000.

According to the guilty plea, Eze, who owns Largo Financial Services, illegally entered Canada in 1991 using a fraudulent passport. After Canada issued a deportation order in 1995, Eze fled. In 1997, he resurfaced in the U.S., using the name and other identifying information of a Canadian citiz

Jamaican Citizen Arrested for Making a False Claim of Citizenship to Register to Vote in the 2024 Presidential Primary Election

PANAMA CITY, Fla. – Jacqueline Dianne Wallace, 52, a Jamaican citizen, has been arrested on a federal criminal complaint and charged with unlawfully making a false claim of citizenship in order to register to vote in the 2024 Florida presidential primary election. The U.S. Attorney's Office for the Northern District of Florida announced the charge after Wallace made her initial appearance in federal court in Tallahassee. U.S. Citizenship and Immigration Services provided valuable assistance to the investigation.

According to the criminal complaint, Wallace entered the United States in December 2010 on a six month B-2 tourism visa and did not return to Jamaica as required. In January 2024, Wallace registered to vote

DHS Terminating Temporary Protected Status for Afghanistan

WASHINGTON – Secretary of Homeland Security Kristi Noem today announced the termination of Temporary Protected Status for Afghanistan. The TPS designation for the country expires on May 20, 2025, and the termination will be effective on July 14, 2025. 
 
At least 60 days before a TPS designation expires, the Secretary, after consultation with appropriate U.S. government agencies, is required to review the conditions in a country designated for TPS to determine whether the conditions supporting the designation continue to be met, and if so, how long to extend the designation.

Cap Reached for Additional Returning Worker H-2B Visas for the Early Second Half of FY 2025

U.S. Citizenship and Immigration Services has received enough petitions to reach the cap for the additional 19,000 H-2B visas made available for returning workers for the early second half of fiscal year (FY) 2025 with start dates from April 1 to May 14, 2025, under the H-2B supplemental cap temporary final rule (FY 2025 TFR). April 18, 2025, was the final receipt date for petitions requesting supplemental H-2B visas under the FY 2025 early second half returning worker allocation.

Litigation-Related Update on CHNV

On April 14, 2025, the United States District Court for the District of Massachusetts issued a Preliminary Injunction Order staying parts of the March 25, 2025 Federal Register notice titled, "Termination of Parole Process for Cubans, Haitians, Nicaraguans, and Venezuelans (CHNV)." See Svitlana Doe, et al., v. Noem, et. al., No. 25-cv-10495 (D. Mass. Apr. 14, 2025). Pursuant to the order, the parole termination notices that were sent to aliens from Cuba, Haiti, Nicaragua, and Venezuela pursuant to the Federal Register notice are stayed and therefore not currently in effect. No new requests for CHNV parole will be processed.

DHS to Begin Screening Aliens’ Social Media Activity for Antisemitism

WASHINGTON— Today U.S. Citizenship and Immigration Services (USCIS) will begin considering aliens' antisemitic activity on social media and the physical harassment of Jewish individuals as grounds for denying immigration benefit requests. Chicago Businessman Indicted on Immigration Fraud Charges

CHICAGO — A suburban Chicago businessman has been indicted on federal fraud charges for allegedly providing false and fraudulent information to U.S. authorities to obtain immigration benefits for his foreign national clients, following an investigation assisted by U.S. Citizenship and Immigration Services.

Jose Gregorio Sosa Cardona operated Delta Global Solutions, Inc., which assisted individuals in applying for asylum, immigrant visas, lawful permanent residence cards, and other immigration benefits. From 2020 to 2024, Sosa Cardona conspired with two employees of his firm and others to knowingly provide false and fraudulent information to USCIS for his foreign national clients who were seeking benefits, according to an indictment unsealed in U.S. District Court in Chicago. The indictment accuses Sosa Cardona of, among other things, fabricating foreign law

USCIS Assisted in Investigation Leading to the Arrest of Central Coast Woman on Complaint Alleging She Created Hundreds of Bogus Medical Documents for Immigration Applicants

LOS ANGELES – U.S. Citizenship and Immigration Services assisted in the investigation of a San Luis Obispo County woman arrested on a federal criminal complaint last month. The complaint alleges she created hundreds of fraudulent immigration documents by misusing physicians' credentials to show compliance with medical examination requirements for immigrants to register for green cards or otherwise adjust their immigration status.

Chantelle Lavergne Woods, 54, of Nipomo, is charged with fraud and misuse of visas, permits, and other documents, a felony that carries a statutory maximum sentence of 10 years in federal prison.

USCIS Assisted in Case Resulting in Bronx Former Attorney Sentenced to 70 Months in Prison for Large-Scale Immigration Fraud

NEW YORK – U.S. Citizenship and Immigration Services assisted in a case resulting in the sentencing of a Bronx-based former immigration attorney. Matthew Podolsky, acting U.S. attorney for the Southern District of New York, announced that Kofo Amankwaa was sentenced to 70 months in prison for immigration fraud in connection with his supervision of a multi-year scheme to file fraudulent immigration documents under the Violence Against Women Act (VAWA). Amankwaa pled guilty on Sept. 17, 2024, before U.S. District Judge Katherine Polk Failla, who imposed the sentence.

Update on TPS for Haiti

On Feb. 20, 2025, Secretary of Homeland Security Kristi Noem partially vacated the July 1, 2024, notice that extended and redesignated Haiti for Temporary Protected Status (TPS). The announcement amends the period of extension and redesignation of Haiti for TPS from 18 months to 12 months, with a new end date of Aug. 3, 2025, and makes a corresponding change to the initial registration period for new applicants under the redesignation, which will now remain in effect through Aug. 3, 2025.

FY 2026 H-1B Cap Initial Registration Period Opens on March 7

DHS Terminates the 2023 Designation of Venezuela for Temporary Protected Status

After reviewing country conditions and consulting with the appropriate U.S. government agencies, Secretary of Homeland Security Kristi Noem has determined that conditions in Venezuela no longer support the 2023 designation of Venezuela for Temporary Protected Status (TPS).

TPS and related benefits associated with the 2023 designation will no longer be in effect starting 60 days after publication of the Federal Register notice.
