F2A Category: Fiscal Year 2014 Movement

The AILA Department of State Liaison Committee has been informed by the State Department that due to the demand of F2A visas by Mexican nationals, the Mexico F2A visa preference category is expected to retrogress in the spring of FY2014.

If the return rate for this visa category decreases, the retrogression may come sooner than spring of FY2014. There is a 50% return rate worldwide for F2A visas which may be due to the fact that some applicants will convert to Immediate Relative visas in order to take advantage of the Provisional Waiver Program or some marriages may terminate before the visa is available.

DOS also anticipates that the F2A worldwide visa preference category will retrogress by the last quarter of FY2014. DOS will include visa retrogression predictions in future visa bulletins.

This means that F2A category for spouses and children of permanent residents is  likely to retrogress around July 2014 for World-wide, India, Philippines and China category and in early 2014 for Mexico.

    1. I am F2A petitioner with PD September 17, 2013. I130 got approved, sent to NVC. Got letter from NVC saying that visa number is not currently available. NVC would have started processing my case if visa number was going to be available in coming months.

    2. You have to wait until your PD is current. Anyway F2A is no movements in last 6 months, and will keep the same point in next few months, and will be retrogressed in the future. It means you have to wait at least 1 more year till 2015 then your PD will be come current. Good luck.
      My PD is Sep10 2013, I-130 was approved in October 2013, and my wife will get her US citizen in July 2014, so I dont need to wait F2A visa anyone.

    6. I know a person whose PD os Sep9th, 2013 and NVC is processing the case. Processing is determined if the person's PD meets NVC's Qualifying date and in my view it is not the cut off date as per VB.

    1. Every month, all consulates are given certain number of visas to allot per month. If they do not allot these visas, it is returned back to DOS. This is known as return rate (number of visas returned per consulate per month).

  4. when Mexico will be retrogressed the cut-off date will give us idea how far other countries will be retrogressed.My priority date is october 2013,I wish I knew what to expect from the bulletin

    1. That may not be true because the demand from Mexico applicant is much higher than other countries. So a 5 month retrogression in Mexico may not mean other countries would also retrogress by 5 months.

I see Mexico has retrogressed to April 2012?Can we expect forward movement for India in fiscal year 2014?Also,if you could publish predictions in your blog about F2A movement in the coming months,it would be really really helpful.My PD is Dec 02nd 2013 with I 130 approved-Any chance of it becoming current in FY 2014? .

    1. Great question, my wife's PD is Sep 26, 2013. One would hope it will retrogress less than Mexico, or ideally not at all and will start moving slowly forward.

    2. Based on the comments made by USCIS/DOS, it does not look like F2A category would move forward till September VB. They have currently predicted it to retrogress around July VB.

  11. I am in legal F1 status and getting married to a LPR in March 2014. I am planning to file all the paperwork with USCIS within a week of my marriage. I am from Nepal and so is to be my wife. Can anyone give me a good estimated idea how long it will take me to get GC? Also, I couldn't find the F2A priority date for Nepal so is it same as India, China, and Philippines?     1. First you have to file I-130 form. Once that is approved, you will have to file I-485 application. There are many links on right side of this page. Please have a look at those. They have been created to answer lots of questions.

    Retrogress to July 2014? 2014 does not look like a retrogression, am I the only one confused by this statement?

    1. It means retrogression will happen in the July 2014 bulletin. Look at the Jan/Feb VB and they have already mentioned itthere.

  13. Im kinda confused. To my understanding visas have been given out to everybody that has a priority date before 08 SEPT 2013 for F2A category. Why retrogress? don't get it!!! can someone please explain.

    1. It means that they are currently processing applications whose PD is before the date mentioned in current VB. Since the demand is much higher than supply, they have to retrogress dates so that they do not exceed the limits set by INA (government).

So basically your saying that a retrogression takes place when there is too much demand and they have to make a stop to give time for processing previous PD visas and also for people to kinda stop applying so visas don't exceed limit. Ok makes sense. Thanks a lot. Now I can explain that to my husband. I just hope this doesnt take that long. I used your calculator and its says My husband will get his GC on Feb 2020.SEPT 30 2013 Is it working properly?

  15. Hey Amazon..My priority date is Sept 27, 2013. I belong to the F2A spouse category for India. My GC interview is over. The officer at USCIS said that he's waiting for visa number to approve green card. Looking at visa bulletin it seems the PD for India has not moved from sept 8th 2013 and it seems to be not moving for next few months. The processing is going on at the snails pace. In your prediction, you have mentioned that there will be retrogression in july 2014. If this retrogression happens when do you think it will move forward in future ? Is there any chance of forward movement before July ? Thanks for your help.

    4. Looks like Amazon is too busy to reply my original post. One thing concerns me the most is this endless wait after interview. They aren't moving an inch since last September. Now god knows how many years they're gonna retrogress. May be to 18th century.

      It would be fine if they make a short retrogression about 1-6 months and move forward fast pace. I wish if they could just move the PD 3-4 weeks forward for India before they retrogress :P.

      If visa number cap for this year is reached then when do you think would the next year quota gonna open ? October ? Do you think this F2A will move forward anytime this year ? Thanks.

    5. Based on last comments directly from USCIS, they do not expect F2A category to move forward till September 2014.

      The earlier it could move forward would be after September 2014 Visa Bulletin.

    When do you think it will approved our i-130? our PD is January 3, 2014 under F2A category. We dont need to wait till our PD will be current. Because my husband will file his citizenship on April. How long it will take to process his citizenship? Thank you so much!

    1. Once the citizenship is approved, you can upgrade your application from F2A to IR.

  17. Hi everyone! I am an F2A petitioner for my spouse who is in the Phils. and I'm currently in North Carolina. My PD is October 8, 2013. Last Dec.17, 2013 I received an email followed by a letter on Dec.25, 2013 from the USCIS informing me of the approval of my I-130 and further information that my case was forwarded to NVC or DOS. Since then and as of this writing I haven't receive any emails neither any communication from the NVC or DOS regarding the update/s of my case. Its been 2 months then. Will this mean that my case was not acted upon or have it taken for granted? What's the best thing that I should do right now? As far as my PD is concern which is still not current base on the upcoming March 2014 VB, how long will I have to wait for my PD to be current or will there any possiblity that it will be current before the end of 2014? Furthermore, should our category particulary under the Phils. can experience retrogression this yr.?

    5. Hi there! Just an update only, u r right sir Muhammad Ali, of saying that it will take 2 to 3 months for for the NVC to notify after the case has been forwarded to them by the USCIS. My wife received the notice from the NVC last March 10, 2014 but the letter was dated Feb. 3, 2014. Unfortunately, it says that no visa is available. Anyway, it call some patience to wait until our PD will be current. I hope and pray it will come soon before the year ends because I already miss my wife.

    i am a green card holder and i filed for my husband in jan 2014. now his case status is showing its approved and is in post decision activity?.. what does that mean?..   22. Dear Amazon, I have a question.
    I have a B1/B2 visa until 2024 and i am planning on getting married with my boyfriend who has a GC. I'm not planning on staying in the US illegally and once I get married, I'd fill out the I-130 from my country. If i do so, would I lose my tourist visa? would I lose the right to enter the US even if it's for a few days to visit and return to my country until I'm granted the GC?

    1. B1 is a non immigrant visa. To get this visa, you have to prove that you will not immigrate to US. Once you file I-130 application, you are intending to officially immigrate to US (and opposite of B1 visa).

      I would recommend talking to a good lawyer about this. In port of entry you can tell the officer the truth (that you have filed I-130 application). It would be upto them to allow you to enter the country. Hence a good lawyer can guide you in this.

    1. Hi there... you'll get your GC as soon as the priority date moves. But it seems that it will retrogress sometime in July 2014. We don't know how far it will retrogress. So you have to keep your fingers crossed.Retrogression will happen for all F2A categories. For Mexico it's already happened.
