USCIS Reaches Fiscal Year 2027 H-1B Cap

U.S. Citizenship and Immigration Services has received enough petitions to reach the congressionally mandated 65,000 H-1B visa regular cap and the 20,000 H-1B visa U.S. advanced degree exemption, known as the master’s cap, for fiscal year 2027.

WASHINGTON— The Department of Homeland Security (DHS) has issued a final rule rescinding the 2022 Biden-era regulation regarding public charge determinations, further aligning immigration law with Congressional intent that aliens in the United States be self-reliant and not dependent on taxpayer-funded government benefits. Under the Immigration and Nationality Act (INA), an individual applying for a visa, admission, or adjustment of status is inadmissible to the United States if deemed likely at any time to become a public charge.

USCIS Opens Asylum Office in Atlanta

U.S. Citizenship and Immigration Services (USCIS) is opening an asylum office in Atlanta. Beginning July 8, 2026, the Atlanta Asylum Office will conduct interviews for affirmative asylum applicants at three locations. Aliens filing for asylum and aliens who have already filed for asylum who are under the jurisdiction of the Atlanta Asylum Office, which covers Georgia and Alabama, will have their interview scheduled at one of these locations:

• A new, temporary asylum office location in Atlanta;
• The USCIS Atlanta Field Office; or
• The USCIS Montgomery Field Office in Alabama.

The Atlanta Asylum Office is expected to move into a permanent location in 2027. Until then, USCIS will use the above

Court Order on Hold Policies

On June 5, 2026, the U.S. District Court for the District of Rhode Island issued an order in Dorcas International Institute of Rhode Island, et al. v. United States Citizenship and Immigration Services, et al., 26-cv-00132-JJM-PAS (D.RI.), vacating PM 602-0192, PM 602-0194, and PA 2025-26. The Court entered its final judgment on June 11, 2026. In this case, the plaintiffs are non-governmental organizations and labor unions who represent millions of individuals who filed immigration applications.

USCIS strongly disagrees with the Court’s order but will follow its terms pending possible further judicial review.

USCIS Opens Asylum Office in San Antonio

U.S. Citizenship and Immigration Services opened an additional asylum office location in San Antonio, Texas. Beginning May 28, 2026, aliens who filed for asylum with USCIS who reside in the jurisdiction of the Houston Asylum Office may be interviewed at either the Houston Asylum Office or the San Antonio Asylum Office. This additional location increases the Houston Asylum Office’s capacity to schedule and conduct affirmative asylum interviews.

DHS Automatically Extends Temporary Protected Status for Lebanon

The Department of Homeland Security posted a Federal Register notice on the six-month automatic extension of Temporary Protected Status (TPS) for Lebanon, from May 28, 2026, through Nov. 27, 2026. Under the TPS statute, if the secretary of homeland security does not decide whether a country still qualifies for TPS at least 60 days before the country’s TPS designation expires, its TPS designation is automatically extended for six months.

WASHINGTON—U.S. Citizenship and Immigration Services today announced a new policy memo reiterating the fact that, consistent with long-standing immigration law and immigration court decisions, aliens seeking adjustment of status must do so through consular processing via the Department of State outside of the country. Officers are directed to consider all relevant factors and information on a case-by-case basis when determining whether an alien warrants this extraordinary form of relief.

USCIS and DOJ Take Steps to Denaturalize 12 Individuals for Concealing Terrorist Support, War Crimes, Espionage, Sexual Abuse, and More

WASHINGTON –U.S. Citizenship and Immigration Services partnered with the Department of Justice in its recent filing of denaturalization actions in various U.S. district courts against 12 individuals accused of serious offenses—including providing material support to a terrorist group, committing war crimes, and sexually abusing a minor.

Under the Immigration and Nationality Act, a naturalized U.S. citizen’s citizenship may be revoked, and certificate of naturalization canceled, if the naturalization was illegally procured or procured by concealment of a material fact or by willful misrepresentation.

The Department of Homeland Security (DHS) is announcing an interim final rule to implement immigration fees and requirements from the H.R. 1 Reconciliation Act of 2025 (One Big Beautiful Bill Act). H.R. 1 created new fees to increase funding for immigration enforcement operations and ensure aliens pay for immigration services.

On July 22, 2025, USCIS published a Federal Register notice implementing a filing fee for Form I-589, Application for Asylum and for Withholding of Removal, and an Annual Asylum Fee (AAF) to be paid each calendar year an asylum application remains pending.

BALTIMORE – U.S. Citizenship and Immigration Services helped investigate Emmanuel Oluwatosin Kazeem, a native of Nigeria recently named in a civil denaturalization complaint filed by the U.S. Department of Justice. Kazeem orchesrated a large-scale identity theft and tax fraud scheme. In 2017, he was convicted on 19 counts—including mail and wire fraud, aggravated identity theft, and conspiracy—and later sentenced to 15 years in prison. President Biden commuted his sentence in 2024 after he had served only six years.

U.S. Citizenship and Immigration Services has received enough electronic registrations for unique beneficiaries during the initial registration period to reach the fiscal year 2027 H-1B numerical allocations (known as the H-1B cap), including the advanced degree exemption (master's cap).

USCIS selected enough beneficiaries with properly submitted registrations to reach the H-1B cap and notified all prospective petitioners with selected beneficiaries that they are eligible to file an H-1B cap-subject petition for those beneficiaries. Convicted Child Sex Offender in Texas Denaturalized With Help From USCIS

McALLEN, Texas — U.S. Citizenship and Immigration Services provided pivotal assistance to the investigation that led to the denaturalization of Carlos Noe Gallegos, a convicted child sex offender. The U.S. attorney's office made the announcement.

The U.S. District Court for the Southern District of Texas issued the order stripping Gallegos, a Mexican national, of his citizenship after he concealed from USCIS during his naturalization process in 2010 the fact that he had sexually assaulted a child. Gallegos failed to disclose both his criminal acts but pleaded guilty to the crime after becoming a U.S. citizen. The court found that Gallegos's criminal conduct made him ineligible for naturalization and that his citizenship was illegally obtaine

Salvadoran Child Molester in North Carolina Denaturalized and Ordered Deported

RALEIGH, N.C. – A federal judge sentenced convicted child molester Isidro Arcenio Alvarado, 58, a native of El Salvador, to active prison time after he pleaded guilty to fraudulently obtaining U.S. citizenship. The judge also revoked his citizenship and ordered him removed from the United States.

Alvarado confessed to knowingly making materially false statements under oath and penalty of perjury on his naturalization application and during a naturalization interview with U.S. Citizenship and Immigration Services. He denied his criminal activity and lied to USCIS officials to gain immigration benefits. Alvarado naturalized on Oct. 12, 2022.

Philippe Bien-Aime, also known as Jean Philippe Janvier, a native of Haiti, used two identities to procure immigration benefits — and eventually acquire U.S. citizenship — after illegally entering the United States.

Bien-Aime's immigration fraud was discovered and confirmed through a comparison of fingerprints that he provided under the two identities. That comparison is part of an ongoing national initiative

U.S. Citizenship and Immigration Services received enough petitions to reach the cap for the additional 18,490 H-2B visas made available for the first allocation of returning workers of fiscal year 2026 with start dates from Jan. 1 to March 31, 2026, under the H-2B supplemental cap temporary final rule (FY 2026 TFR). WASHINGTON – Secretary of Homeland Security Kristi Noem today announced the termination of Temporary Protected Status for Yemen. The termination is effective 60 days after the notice is published in the Federal Register.

WASHINGTON – U.S. Citizenship and Immigration Services was instrumental in the apprehension of an MS-13 gang member and confessed murderer in Virginia just weeks before Virginia Gov. Abigail Spanberger took office and ended the state's cooperation with U.S. Immigration and Customs Enforcement (ICE).

Through rigorous screening and vetting of his applications for asylum and work authorization in the United States, USCIS identified Edwin Antonio Hernandez Hernandez's extensive criminal history and illegal status. USCIS officials coordinated with U.S. Immigration and Customs Enforcement, which resulted in ICE swiftly arresting Hernandez, 27, of El Salvador, at a USCIS appointment in Alexandria.

FY 2027 H-1B Cap Initial Registration Period Opens on March 4

U.S. Citizenship and Immigration Services announced that the initial registration period for the fiscal year (FY) 2027 H-1B cap will open at noon Eastern on March 4 and run through noon Eastern on March 19, 2026. During this period, prospective H-1B cap-subject petitioners and representatives must use a USCIS online account to register each beneficiary electronically for the selection process and pay the associated $215 H-1B registration fee for each registration.
