Who are you to decide marriage is true or not.Though process and human relations are separate on paper they should go hand in hand for ethical reasons.So it is unethical on part of USCIS to separate husband and wife.Period.

Just got my NVC case number. PD March 10, transferred case from Vermont to California.
ReplyDeleteCan someone tell me the fees that I should pay in this step? I got two bills, one $120.0 as Affidavit of Support Fee and one $ 325.0 for Immigrant Visa Application Processing Fee. Is that all?
DeleteYes, it is all, but when they sheduled your Interview you have to spend in medical examination and other minor expenses.

DeleteYou have to pay &120 first for Aos then fill out the form and submit with the supporting documents. The next step is to pay $325 and fill out the IV form. Those two payments are all you need to pay.

ReplyDelete**Yes, my PD is February 2014 and my case is complete. I am very worried because my daughter is turning 21 in September- which will most likely be before the case becomes current. According to the attorney CSPA does not protect her and nothing can be done to expedite my case. I am more than anxious.....

ReplyDeleteThe fact that people with priority date jan-feb-march etc recived welcome letter or completed case DOESNT mean it will be a big jump!! theres people from aug-sept-oct that completed their cases a while ago and there was not a big jump. please stop giving ppl fake hope and get them excited with bad predictions, lets just hope there is a big jump but dont say something if ur not sure, lets be patient and see what happens. dont desesperate, the wait it is sad, just enjoy your life while you wait, you will be reunited with your family soon. just dont frustrate. i am way from my family too and waiting

ReplyDeleteImmigrant community is more than ever waiting for the release of June 2015 Visa Bulletin to see whether the State Department is implementing immigrant visa reform mandate of the President Obama. The USCIS has been seeking stakeholders input on these issues and we have learned that the AILA recommended to implement the following reforms. We fully agree with and support the AILA's recommendations and ask the State Department to implement the following reforms which may even not require the rule-making process.
Allocate immigrant visa numbers that Congress provided for and intended to be issued, and recapture the immigrant visa numbers that were not issued in past years: As reflected in INA §201, Congress clearly indicated its intent to ensure that no available immigrant visa number should go unused. The statutory scheme sets forth a system whereby unused employment-based visas are to be passed to the family-based category and unused family-based visas are to be passed over to the employment side. Moreover, under INA §203, unused numbers within each of the family- and employment-based preferences trickle down to the next preference within the broader categories. Yet despite this clear mandate, it is reported that approximately 220,000 family and employment-based visas have gone unused. Although recapture of unused numbers has previously been accomplished through congressional action, the INA does not specifically prohibit the State Department from exercising its authority to recapture unused visas on its own. Moreover, cases indicating that recapture is not possible are limited to or based on recapture of visas under the DV lottery. Unlike the family- and employment-based preference scheme, there is no congressional mandate for unused DV lottery numbers to be carried over to the employment-based or family-based categories or vice versa.

05/08/2015: The United States Digital Services in Charge of "Technical" Part of Modernization of Immigration System
ReplyDeleteConsumers must have noticed lately that the USCIS has been going through a lot of technical changes with the online services and management of immigration business. Here is the report of 05/07/2015 from the Uniteed States Digital Services which apparently has been created by the OMB of the White House to take charge of technical reform of the immigration system. This report gives a glimpse of "What is Going on" from the ongoing technical changes with the USCIS immigration management system. This report does not help a bit to understand procedural and substantive program modernization of immigration system under the President's immigration executive actions, but at least gives some information to our "techy" readers for the direction of forthcoming technical changes to the immigration system. You can participate in this technical modernization process of the United States Digital Services. Obviously, a new "younger looking" Technical Director in the White House plays an important role. Such technical reform will bring with it some aches and pains for non-techy consumers of immigration services just as any other online services did including the government healthcare system. Amen!

ReplyDeleteThe Gang of Eight's bill requires that all supposedly "unused" green cards from 1992-2013 in both the family-sponsored and employment-based categories be recaptured and issued in 2015.
Under current law, the annual cap for all preferences in the family-sponsored green card category is 226,000. Between 1992 and 2012, the U.S. failed to issue the full number of green cards in 14 of the 21 years, amounting to 298,436 green cards. These green cards would be issued in 2015.
In the employment-based category, the annual cap between 1992 and 2013 was 140,000 green cards. The U.S. failed to grant the full number of green cards in 10 of those 21 years, amounting to 404,658 green cards. But that's not all. Remember, the Gang's bill creates a new employment-based preference for spouses and minor children of employment-based green card holders. Using the same 54% from before and applying it to the 404,658 recaptured employment-based green cards, that's another 474,000 green cards that would be issued in 2015!
That makes a grand total of 1,177,000 green cards issued through this additional provision."

I have filled DS261 form and I was able to pay the fees for AOS, Anyways, I got to know that, there were some technical issues hence we were facing the problem and i have take appropriate action (sending IV fees via mail). The 4th Preference category for example (Sisters and brothers of adult U.S.C citizens) has a 65,000 visa allocation, but it can use any other unused visas in the first three Family-based categories (F1 – Over 21 unmarried sons and daughters of U.S. citizens; the F2 (Second Family based subdivided into F2A – spouse and minor children of lawful permanent residents and F2B – over 21 unmarried sons and daughters of lawful permanent residents and finally the F3 – married sons and daughters of U.S. citizens.
Visa allocation for the Philippines and three other countries are always used up since there are more applicants than visa available under the yearly per-country limits (25,620).
When a visa petitioner dies, or a visa applicant does not pursue his or her immigrant visa application, that visa is not used and by regulation must be returned to the visa allocation for that year so that others may use it.

Over the years, unused visas were never returned also called “recaptured.” Hence, the spirit and intent of Congress under Section 203 of INA is being ignored at least, violated at worst.
It is reported that approximately 220,000 family and employment-based visas have gone unused.
While in some instances, unused visas have been recaptured by congressional action, the IMA does not specifically prohibit the State Department from exercising its authority to recapture unused visas on its own initiative or even use available visas as regulations allow.
The same is true with the U.S. Citizenship and Immigration Services (USCIS). In July 2007, the USCIS used up all the 3rd Preference Employment-based categories. On the first day of July 2007, the U.S. State Department reported that the EB3 category was “Current”.
The next day after the USCIS exercised its discretion to allocate the visas to those in the United States applying for adjustment of status, the State Department issued a revised Visa Bulletin showing the EB category as “Unavailable.”
Anticipating the administrative initiative to institute immigration reforms within its mandate and authority, the Obama administration (which includes the Department of State and the Department of Homeland Security which in turn trickles to the consular posts/Embassies and the USCIS) is widely expected by the immigrant community to exercise its authority – without need for Congressional action – to allocate or recapture the reported 220,000 immigrant visas.
By recapturing and reallocating the 220,000 immigrant visas, the backlog or retrogression of visa cut-off dates would ease significantly.
Hopefully, the 7-year retrogression of the EB3 will return to just months of waiting and the Family-based categories specifically for the F2A, F1, F2B, F3 and F4 will move forward faster.

ReplyDeleteim not exited for a jump because i am scared they will make a retrofression, lets just wait for what happens and have hope it moves fast. remember before last retrogression they didnt give visas to all the current people so i dont want tonwant for a big jump but i dont know how this works, we should just wait...

Yo need to obtain PCC from both passport office and from district SP offices.Folow this link http://passportindia.gov.in/AppOnlineProject/online/pccOnlineApp to apply for PCC from passport office.And for clearance from SP office, visit district SP office in direct and apply.

Deleteyes..I have sent the packet.You don't need any document from NVC to obtain PCC.For obtaining PCC from passport office,take an appointment from passport seva kendra and visit with your passport.PCC will be issued on the same day itself.And to get from SP office, visit district SP office and give an application for PCC.They will issue PCC after back ground checking with your local police station.this may take 1 or 2 week.
