  1. I have my first pd from dec 2007, but now new perm with new employer applied in April this year and is pending approval.

When do you think the pd will reach or cross 2007 after the december retrogression.

I read, USCIS/DOS adopted the new strategy of applying 2800 visas beginning of each fy instead of doing it last quarter.

    Any insight greatly appreciated Thanks

    1. why do not you stuck with that employer until you get the GC, i am not sure why some guys keep changing employer.

    2. Old employer filed in eb3 and got laid off but was able to find an employer who was willing to do eb2 but didnt start process until early this year.

Moreover, since I am from India, the estimates said I will get my gc by 2040 if I were to stick with eb3.

    3. If the I-140 is approved from old employer, you can retain the old priority date.

    4. Hi Amazon, does it make a difference if the new employment is in a different state. Eg. I got I 140 approved in Tx with priority date as feb 2012 eb2 India. Now if I move to California and if the new company goes thru perm and 140, still my priority date remain the same as feb 2012. Thanks

    5. It should not matter as long as the job description is same. Your new company lawyer can help you with this.

  2. "Note: Based on data from GC Tracker and Forum, USCIS is currently approving I-485 cases in just 60-70 days. This is faster than the 4 months processing time listed on their website."

Is it 60-70 days from the receipt date or from the notice date? There are two dates in the receipt that I got from USCIS. And I see that there is pretty much a 1 week difference between the receipt and notice dates.

    Thank you.

  13. Hello Amazon. The bulletin just got released. With the exception of Indian priority dates which saw some expected retrogression, there has been some significant movement across all employment-based categories. I've been reading details about spillovers from this blog and others as well, and my question is, is there some truth to discussions regarding the distribution of spillover numbers in which they might change the strategy from waiting until the end of the fiscal year to apply those numbers to actually applying them as early as today?

    1. That is correct. I will add a blog post about this.

    1. The best way to go about this would be to consult a lawyer. There is such a thing called the CSPA (Child Status Protection Act) that deals with children that aged out while enduring all the delays in their immigration application, and your lawyer would be able to determine if you qualify for this. In your case, your child would not be considered a minor anymore by the time your PD becomes current and would then be classified as F2B, which would kick back your daughter's delay another 7-19 years depending on your nationality.
