  1. How come the cut off date for EB3 move forward with only 4 months? Frustrated!

    1. Actually, it moved only 3.5 months, not 4.
      Makes sense, as long as they don't surpass the capacity and don't make any retrogression.

  4. Only in october, EB2 India will touch 1 Jan 2008. Not before that. This is super star's prediction. :)

  5. My PD is August 2009 EB3ROW. My daughter turned 21 2 weeks ago. I was praying hard that we would make it under the radar before they hit the brakes. That hope has just been dashed. It is so annoying that she must now go it alone. She has been in the US since age 11 and knows little about our old country. She graduates college next year.
    This whole system is so screwed up.

    1. I am happy regarding the 4 month movement because hubby's PD (June 2009)is now only 5 month's away, but simultaneouly disappointed that there'll be no further movement for the next couple of months. As long as the dates don't retrogress, I'm happy.

      Can your daughter get an H1 sponsor when she completes her studies or does she have to return to your home country?

    2. We are hoping she can get a sponsor. We switched her to F1 last year from H4 and they granted her a 4-year student visa. Although only valid while she is a full time student, her paperwork is good thru 2016. If a child has turned 21, you can add on the processing time which may have bought us a couple of months but now we're probably looking at next year and there's no way we can claw back that much time.
      Having just advanced by 18 months, I would be surprised to see any forward movement for another 6 months.

    3. EB3 ROW is likely to move forward in around 3-4 months. We will have to wait for USCIS to release the latest data to crunch some numbers.

    5. The best thing USCIS can do is allow people to file for EAD/AP card after I-140 is approved. This simple fix would help thousands of people. There was talk about USCIS implementing this fix, but it seems to be stuck in their long process (similar to EAD for H4).

  6. I was hoping some movement for EB2 India, this whole thing sucks ! My PD is Oct 2008 EB2 India, any idea when can I expect dates to be current ?

    1. Based on amount of spillovers from other EB categories and expected porting rate, EB2 India could potentially move to around April 2008 in next 2 VBs.

  7. As per late st July bulletin remarks, there will be no additional movement. This cut-off date has advanced 18 months during the past three months. Such rapid movement can be expected to generate a significant amount of new demand, with the impact not being felt for three to five months. Therefore, the cut-off date will be held until it can be determined what level of demand is to be expected, and whether it is likely to be sustained.

    1. We will have to wait for updated data from USCIS. If demand is much higher, EB3 ROW could retrogress.

    2. Hello Amazon,
      A question for you: Why does it take so long for USCIS to determine the demand for EB3 ROW? And if the fiscal year is over and they "discover" that the demand was lower than the number of visas allowed for this year would be those visas be wasted?! My guess is that the demand was much lower than usual between 2007 and 2009 due to the economic recession

    3. There are two types of "demand". (1) Number of applicants (primary and dependents) who file I-485 applications. These appear in I-485 pending inventory.

      (2) Applicants whose I-485 has been approved. This is the real demand.

      Sine it takes about 4-8 months to process the I-485 application, USCIS (actually DOS) takes some time to find out the REAL demand.

      Based on historical data and few estimates (I-485 approval rate), they can estimate what the real demand could be. Based on this analysis they have stopped moving EB3ROW dates.

    1. When visa bulletin dates exceeds your priority date in related category then your priority date is said to be current. Then you will become available for the interview and ambessy schedule your interview acc to available dates.

    3. Current means VB dates for F2A will move to Aug 2013 (instead of Oct 2011).

      F2A will retrogress once enough I-485 application is filed (and supply is fulfilled) probably around Nov/Dec VB.

    4. Hi amazon thank u for this blog but im still confuse, i filed for f2a pd is aug. 30 20!2, so when vb becomes C all visa are availblwe right? So is it first come first serve basis? What if someone who has a pd of jan. 2013 filed a i-485 before i do, will he get an interview first? Do i have to hurry up before they ran out of visa for my husbqnd? Thnks a lot

HI, Amazon, EB3-ROW and EB3C seems will slow down or stop for a while soon, I have EB3C PD Nov 2010, If I port to EB2C now and get a new PD supposed March 2014, however suppose in early 2014 EB3-ROW/C cut off date move beyond Dec 2010 (due to low demand date), then I will screw up because my new case will be in EB2C I can not file I485 or I can file I485 using EB3 PD but have to wait until EB2C cut off date reach my EB2 PD to get GC? (that would be screw up), or it doesn't matter, I have 2 cases open, which one earlier I will go to that one? Thanks for helping me to understander this matter

    1. If you port from EB3 to EB2, you can still retain your old PD.

  14. My EB3 ROW dates became current with this visa bulletin. From what I understand I should be able to file for my I485 on 1st of July, but I will be outside the country due to family emergency. I am returning back on 10th and planning to file I485 then.

    What happens if the August visa bulletin comes out and if the PD for EB3 ROW has retrogressed and my PD is not current. Can I still apply in July as my PD was current in July bulletin or I cannot because the dates retrogressed in August bulletin

    1. You can file I-485 as long as PD is current. If dates retrogress, USCIS can still continue to process applications (first priority would be applications which are current).

    2. To clarify: If PD is current in July VB, you can file anytime in July.

      If PD is current in August VB, you can also file anytime in August.

    3. I think the question is if the date gets retrogressed for the August VB (lets say on the July 10th), will the people current in July be able to file the 485 after July 10th and before August 1st

    4. Yes, because July VB is valid from July 1 to 31. August VB is valid from Aug 1 to 31. It does not matter when the Aug VB is released, only the effective dates is important.

  16. my mothers sister filled i-130 form f4 fr my mom at may 2004...how long will it take fr us to be current as its already more dan 9 years...
