Please see below prediction for August 2013 Visa Bulletin (for both Family Based and Employment Based):

Quick Summary:
  • EB1, EB4, EB 5: Current
  • EB2 Rest Of World: Current
    EB2 China: 7 weeks (still behind EB3 China)

  6. Hi, I hope you can help me. If F2A is current next month, do you think it will remain that way?
    I filed the 1-130 for my husband, with a priority date of May 8, 2013. I see that they are still approving September 2011 i130's though. What does that mean for me? Will I have to wait for 2 more years till the i130 is current? Please help!

      For second question, it means they are currently processing I-130 cases with PD till Sept 2011.

  7. How can EB2 China be 01OCT08 while EB3 China is 01JAN09? They are giving priority to people with less education?!

    1. There is just a greater demand for EB2 china. Each EB category is only allotted a certain amount of visa's. You must also consider those porting over from EB3 to EB2.

    2. Just a fyi, EB3 does not necessarily mean the person is less educated. This is a common misconception.
      It is up to the employer to decide what is the minimum education/experience needed for a particular position. That is the information used to determine if they will file for Eb3 or Eb2.
      A person might have a Masters degree with 5 years of experience. But if the position requires (as determined by the employer), only a Bachelors degree and 0-2 years experience at minimum, the employee's application will be filed in Eb3, and not Eb2, though technically the employee has all the credentials for a EB2 applicant.

    3. Just to chime in: Employers decide whether Masters degree is REQUIRED for that job description. So if masters degree is not required but the person has masters degree, they would file in EB3 category.

      Very few jobs in IT really REQUIRES a MS degree.

      Currently the demand in EB3 China is lower than EB2 China. In few months, EB2 China will be ahead of EB3 China.

    1. If any of your petitions are outside the service center's reported processing times, you can call the customer service (number on right side of this page) and ask for a formal inquiry into your case.

    2. amazin, i know that usually it takes 2.5 years for f2a to be completed... my question is, since f2a will be current soon, does it mean our waiting time will be shorten? thank uu so much

    3. If F2A is current in next two VB, you would only have to file I-485 and wait for USCIS to process the application.

      Questions for Amazon: So Can I fill the form and submit it now just to be ahead in the line?? Let us say the the PD for F2A becomes current in August 2013 Visa Bulletin puiblished on July second week. So can I send the application for I485 right in july 2013 second week? Or do I have to wait till August 2013 and then mailout the application?

      Please clarify!

    1. It is unusual to have so many RFEs coming out. This could be due to June 3 memo from USCIS. Dates for EB2 India is expected to move by 3 years in the next two VB.

  11. Hi Amazon great news on F2A. Here´s my question. I am a US resident filing for my wife and her PD is 12/22/2011. She has a valid B1/B2 Tourist Visa that gives her up to 6 months of legal stay in the US. Is there a way for her to not go through the embassy and all the immigrant visa thing and have the interview here?? Can she apply for AOS with the type of case we have???

  12. Hi Amazon my PD is Sept 2007 EB3 Philippines. 1-140 got approved.

    With all these influx of RFE news going around I decided robust check our case online and was surprised to see my 1-140 is back to initial review even if it were already approved? I even have a copy of the approval notice? Should I be worried and anticipate for my RFE or should I be excited and anticipate that my PD will be current In the next visa bulletin?

    1. I would recommend calling USCIS and asking them to check why the status changed for I-140 application. It could be a system error.

    1. RFE is Request for evidence.

      USCIS issues RFE when they want more documents from applicants (such as birth certificate, photos, marriage certificate, I-94 copies, etc).

  14. amazon, ive checked f2a movement for the past years and it will be the frst time for f2a to be current ? am i correct ... dont kno id its a good thing for f2a filers or can lengten our waiting time ...thnks

    1. If F2A becomes current, yes, it would be first time in recent years that it happened.

      The waiting time depends on the volume of application received by USCIS. If they dont move dates fast, then many FB visas would be wasted. Last year USCIS wasted over 18,000 visas in FB category. You can read it here:

  16. It mostly likely feel as if you miss the boat during FY2013 there could be hardly no movement in FY2014 because of unknown factors such as porting.

    1. Yes that is very likely since porting from EB3 is currently using up all available quota allocated to Eb2 India (2802 visas).

    I checked on trackit xls the RFE was recd by at least 10-12 applicants for March 2008. Does that mean that there are high chances that the COD would move as far as March 2008 in Aug/Sept VB ?

    2. Dude tackitt has around less than 10% of EB2 India. For other categories (eb3row, FB, etc), its less than 0.1% - 1%. Dont rely on data from there. It is a small sample size.

    3. Majority of RFEs are around March 2008 PD. There are very few RFE for PD upto August 2008. So there is a higher probability that dates could move to around March 2008.

  18. Hello Amazon,
    I am EB3 India "derivative" of my parent's greencard. I am currently over 21 but still qualify as under 21 due to CSPA. My question is: If my I-130 is filed and then when F2A becomes current, will I be able to use my CSPA age (of under 21) towards my NEW I-130 to qualify as F2A? If I cannot then I will be F2B which will be useless but if I can that would be awesome. That way I may not need to wait for my I-485 EB3I to be current but can take advantage of F2A being current.

    I hope you say this is possible and/or send some helpful links on those lines. Thanks a ton.

    1. Since CSPA rules are complex and changing, I would recommend talking to good lawyer about this. They would be able to review your case and provide proper guidance.

Hello everyone!I came to USA on visitors visa 10 days back..and I want to get married to my girlfriend who is a Green Card holder.Initially I was planning to leave US after getting married and wait for consulate proccessing in my home country BUT as the priority date of F2A has become Current..can I stay in the USA and apply for Adjustment of Status??If someone could help me with this regard I would be very thankful..I dont have much time left!!

    1. You need to talk to lawyer. USCIS can consider this as fraud since visitor visa has a non immigration intent.

      You can definitely marry and file I-130 petition. But you may have to go back. A good lawyer would be able to help you with this (or even avoid going back).
