    I don't understand the last part. Why would the approval process go quicker if the dates retrogress?

    1. As anonymous wrote below, USCIS is trying to use up all quota before Sept 30. Hence they are approving applications in just 60 days (instead of 4+ months processing time that they have posted on the site).

      If they change processing time to 2 months, they would be swamped with people trying to open service request.

  3. It means USCIS will try to approve as many as possible before the deadline Sept 30, so that the remaining numbers left for FY 13 can be used up, not wasted. Fiscal yr14 starts Oct, thus dates could stop or possibly move back if therr is too much demand.

      I do not see any record for that name in DB. Also did you get any error message when you submitted data? You should get a data submitted successfully message at the end.

      I tried just now and was able to successfully add new cases.

  6. i think some of those persons that got quick approvals are citizens where as Permanent residents/Green Card Holders have a different waiting time or i should say a longer waiting time if u check the Processing Time Data sheet..My question is for Green Card holders is there anyone who got approval for their suppose with PD Nov/Dec 2012 and is waiting for consular processing

    2. I havent had a chance to go through it yet. Since USCIS is approving many applications in 60 days, all approved I485 applications would not show up in this document. Thus the actual demand would be higher than listed in the I485 pending inventory.

      How do you say it can go till 2011? Isn't the EB2 inventory till 2007 or 2008 around 16000 which is way more than the expected spill over? Just curious..

    3. Here are some numbers:

      Expected spillover: 12,000
      Porting to consume: 4,000
      Remaining: 8,000

      This would move dates to between February 2008 and April 2008 (as Amazon mentioned).

      Now if porting rate from EB3 India increases from August 1, it may only move to February 2008.

    4. To MATT: I do not feel CIS is going to count porters from Aug 1 as they cannot approve them by the end of September 2013. How did you get your numbers?

    5. There are two types of porters: those who have already file I-485 (and are possibly preadjudicatd) and those who have not filed I-485.

      The amount of people porting from EB3 India to EB2 India who have filed I-485 is very high based on EB3 India demand data numbers. So 4,000 may be low.

    6. To MATT: But wont the guys who filed for I-485 with Eb3 and then moved to Eb2 show up in the USCIS pending inventory on the Eb2 category. Which is cumulative demand for Eb2 before Jan 1 2008--Somewhere around 8000. Isn't this Regular + (Porters who have the I -485 filed)...

    7. USCIS is supposed to count these porters only when PD is current (even though they have interfiled a long time ago). Hence as soon as dates move forward and become current, the real demand will increase.

      I am sure both USCIS and DOS is aware of this and is not sharing that data; probably because they do not have a good count of porting numbers.

    8. Based on MATT's analysis how come people with PD May/June 2008 are getting GC's? Just last week we heard about 2 cases as Amazon was reporting. Dates could go as far as June 2008 atleast.

    9. The USCIS officer may not have looked at dates when approving the application. So they would have approved application having PD after Jan 2008 in error.

  11. Hi guys ,I call uscis 4 weeks ago and ask about whether my 485 is pre adjudicated or not. I got call from them few day later and he did not specify anything. But last week, I got call 8773768929 again and they said my file pre adjudicated and waiting for visa number. My priority date in July 2007- EB3 then change to eb2 in December 2012 And I have applied I 485 for my wife in my eb2 category this month. Do u think I will get my gc
    first then my wife will get it and how long its takes to get green card. as I am reading, people are getting green card may 2008.when I will get mine?

    1. Typically, it takes USCIS about 3 months to process a AOS application. If your priority date is current on Oct 30th, you will get a GC. If not, they will issue your wife an EAD I-797 and you both will get AP.
      GC will be issued the next time when your dates become current (June-July 2014)

    3. Typically USCIS processes I485 application based on the I485 receipt date.

      If cases are preadjudicated, then they use PD.

    6. I file my 140,485 in July 2007 ,change to eb2 in2012 them did interfiling for I 485 from eb3-2 in feb 2013. What is my receipt date. I did retain my PD . I do not understand how can they are skipping older pd and giving approval for 2008. Please explain me, I am.really frustrated.

  13. Based on latest inventory up to 7/17, demand for EB3 row is very low... Shouldn't this translate into substantial movement for this category (read 2-6 months)?

    1. These are the cases that USCIS is currently processing as of July 17. It does not include US embassy cases which is around 15%.

  19. How will waiting between Friday afternoon and Monday afternoon help USCIS determine the EB3 to EB2 porting? Will they work on the weekend? If they will,would the number of applications received over the weekend be so much as to affect the potential movement of EB 2 India?

    As mentioned in the site
    September is the last month in FY 2013. All 158,000 (140,000 + 18,000 spillover from FB category) visas should be used up this month

    Question is

    As per Augus bulletin ,few FBI india category has priority date of F1 - 01sep06;F2b - 01 Dec05;F3-08Dec02;F4-22JUN01.

    How still spill over (18,000) comes from FBI to EB2I category. Instead they can use the spill over to FBI category rite.?

    Will we get this huge amount of spill over next year & also any reason for not getting these huge spill over in past & how we got this huge amount of spill over suddenly this year.

    As mentioned in the site

    If EB2 India/China is not able to use up all spillovers, it will flow to EB3 categories.If that happens dates would start moving forward in EB3 categories (ROW, China and Mexico)

    As still our EB2I priroty is Jan 1 ,20008 as per aug bulletin. It means there are still more application priroity date after Jan 1,2008 till todate. So in that case unused visa number will be allocated to EB2I . If it is the case , how come the unused visa number will flow to EB3-ROW/I category?

    1. The numbers below are random:

      Let us assume total 14,000 spillovers to EB2 India. Now 12,000 spillovers were allotted to EB2 India in Aug VB. This means DOS is expecting to allot remaining 2,000 visas in Sept VB.

      Based on 2,000 visas, DOS moves date to 08FEB08 in Sept VB. However, the actual demand in Sept is only for 1000 visas till 08FEB08. USCIS cannot allot any visas to PD after 08FEB08.

      Thus there will be spillovers of 1000 visas from EB2 India.

    2. Hello, i'm extremely sorry that i made a mistake, in fact i received NOA2 on feb 2013 and i'm a Green card holder. I have filed for my Wife and she is waiting for the interview to be scheduled. I called NVC last week and they said that my case is not yet been sent to the Appropriate Embassy where my wife will be interviewed. Since my priority date is current so when i should expect interview ? Thanks!

    3. You should contact NVC and let them know that your I-130 was approved around 6 months ago. If you are in US, you can go for Infopass appointment (where you meet with them face to face).

    6. You can ask them (during infopass meeting) why they havent yet sent the files to local embassy in the last 6 months. They might also be able to give you more details.

  27. I have filed my I-485 July 2013 and I have had my biometric appointment last week. The status of my I-485 is still at Acceptance and the status of my I-765 and I-131 are both at Initial review. According to the explanation my I-485 should be at Initial Review as well since I had already my biometric appoitment. Can you please tell me how this works. My I-140 has been approved in 2009 but still shows Acceptance online.

  28. The reason for the delay in release of VB could also be because of US embassy closures across multiple countries. Consulates outside US are crucial in determining Consular Processing Numbers which in turn will determine the cutoff dates.

    I guess that is a more valid reason than EB2 I spillover calculations.

    All those consulates re-opened on Sunday. If that was the real reason, I doubt it may be out even today because today is the first business day for the consulates, hope we get it at least in the next couple of days.

    1. Only 19 of the 294 US embassy were closed and only for few days. I am sure DOS would already have an estimate of demand from these 19 embassy for last few months to calculate September demand.

      The demand from middle east is much lower than demand from India.

  32. Spillover does not happen every year so DOS is taking time to count and estimate relative visa numbers for each bulletin before next fiscal year starts in october. DOS is most likely to release visa bulletin tomorrow .

    1. It would depend on the type of visas. If you have work visa (H1, L1, TN, etc) you can work in US.

      If you have visitor visa, it does not allow you to legally work. You would have to change visa type to work visa.

  35. My PD for EB2 India is Dec2007. I got an RFE in June and responsed by July 16. My status still shows decision pending upon review of RFE. Should I be concerned? Are others whose PD went current in Aug VB seeing approvals coming through?

    1. Yes. USCIS is approving applications which were issued RFE in June 2013.

    3. Each applications is assigned to USCIS officer. It is completely upto officer when they process the application. You can call them and ask them for updates.Tier 2 officer would be more helpful.

  38. Would my wife receiving an RFE (to prove that we are married) affect my case too? We are EB2 India, Jan29, 2008 PD. We may become current. Just wondering if the RFE affects both of us. We did respond to RFE within a week but not sure if the response would be seen in time.

    1. I think you should expect your GC any time after Sep 1st. These dates are effective from Sep 1st. There is a possibility that you may even receive earlier (based on reports that some people recevied GCs with later dates from previous bulletin). Good Luck :)

    I am having some difficult in interpreting the statement below in quotes which is on the NVC bulletin. I have a few questions 1) Does this mean they will retrogress and have a new date in Oct or does it mean that the new date will essentially be Oct 2013 and then it won't be current moving forward after that 2) Does it mean as they state, that anyone whose case has been initiated by the NVC already before October will get an interview and their process won't stop or does it mean they will also get the visa if approved or just the interview.

    3. Also - what I'm confused about is this. Lets say they complete my case this week. Now they usually send out interview letters a month before the actual interview date. So say they decide to interview my wife in October and send out the notice in Sept. Which PD will they base their decision on, since the NVC people said they only get the PD when everyone else does. So will they base it on the Sept VB or October VB.

    2. So my EB2-India date got current. I-140-485 were filed together last year and I-140 is approved. I've EAD/AP since last year.
      What is the process to find out if my case is pre-adjudicated? AFAIK this date will stay current for 1Month only so do't want to miss the boat.

    2. My priority date is April 6, 2010 -- what a huge, expected surprise :)! I was thinking something maybe afoot with the delay in publishing the visa bulletin, and what seemed like low demand post July 2007 (due in part to the recession). However, I was not expecting (but always wishing) that the cut-off date would move the 15(+) months that I needed for my priority date to be current. I have already been in contact with my lawyer for filing the adjustment of status. Of course, I will only truly believe it when
      the I-485 has been filed and I have the receipt.

      The one sour note is derivative permanent residency for my son. He turned 21 last year and ‘aged-out’ last October (9 months ago!). He is now on a F-1 student visa, graduated from a major U.S. public university in May with a B.S. in biology, and is starting a M.S. in environment science (working on an EPA project). Hopefully there will be some immigration reform, such as a STEM visa, which will allow him to get his permanent residency when he graduates.

    I have a situation and I need some advice. My EB2 PD is April 16th.

    I changed my job last month and filed I9 with another company. I didnot file AC21 though. Is it wise to file AC21 now with the new company? I am unable to take a decision.

    1. I'm also OCT 2010. Our turn should come up pretty soon based on the notes that come out with VB. Demand has been really low and is not expected to grow much... We might be up the VB!

    2. It is hard to predict the VB in Oct. Most people said it wouldn't move at all from August to Oct, but it moved 18 months in Sept.

    3. I am guessing this is for EB3 ROW. If USCIS receive a large volume of applications, they might retrogress EB3 ROW dates so that allotted visas does not exceed the quota.

  58. My pd ís 22 oct 2012 for F2A ctegory undr LPR..ón aug 13 2013 they updated my case and transformd my case tó local uscis óffice..the new óffice has jurdictíon to ur case and will notífy u with decision after further processing..what dóes thís implies tó,pls amazon do u have any idea??

    1. USCIS has sent case to the local office (near you). This local office will contact you for next steps. If they do not contact you for a while, you should call USCIS or NVC for case status update.

    Finally, we are current. However, my daughter turned 21 on 18th May.
    What are our options? Is there a chance she will still be covered? Is there any appeals process if it is determined she has aged out?
    Our PD is August 2009 (EB3 ROW).

    1. Chris,

      Your daughter maybe lucky under the Child Protection Status Act (CPSA), which adds the time your I-140 was being processed by the USCIS to her age. In other words, if it took 6 months for your I-140 to be processed and approved, then those 6 months are added to your daughter's age, whereby she would 'age-out' in November 2013. I recommend you act quickly with filing your and your family's derivate I-485s to make sure your daughter does not ‘age-out’. Once her I-485 application is filed her age is frozen, and will not ‘age-out’.

      Unfortunately, my son is not so lucky. As I posted (anonymously) above he ‘aged-out’ about 9 months ago even with the I-140 processing time.

      To answer you second question, there is no appeals of ‘aging-out’.

      Hopefully your I-140 filing > processing > approval time adds enough for your daughter to file a derivative permanent residency visa adjustment of status application under I-485 application. Could you please update me on what your attorney says as a reply to this post.

      Since my son has 'aged-out' last fall after being here for many years: grade school, high school, university with a B.S., and now university for a M.S., and there are no appeals of 'aging-out', I am taking the issue up with my Representative and Senators. If it is unfortunate that your daughter has recently 'aged-out' I would like to use that information when communicating with my congressmen. Thank you.

    4. My daughter turned 21 May 18th. That's 106 days before Sept 1st. We actually paid $1000 for premium processing of the I-140 as we were approaching the 6-year limit and so it only took 52 days for approval. We have a gap of 54 days.
      We are considering just filing anyway and hoping they don't pay too much notice and just let it go. It's a $1,000+ gamble but if it works out, we will be golden.
      If it doesn't work, we lost $1,000 and will move on to examine other options.

    1. Does this mean in EB2/EB3 India will get their GC who are current considering that they already filed their 485 and so far they didn't get any RFE ?

    2. Is it 100% chances to get GC? or out of all some may get and some may not.

    3. Do we need to give fingerprint again? My PD will current from next month. I read somewhere that fingerprints valid only for 15 months. For me it already 16 months passed when I given. The dates will be remain current for a month and if we need to give again what are the chances to get GC?

    1. 1 and 2. It would depend on when USCIS officer process the application. It could be random.

      3. It is upto USCIS. Many times they extend the validity of FP. If they want another FP, they would send another notice to the applicant.

  62. Hi, I'm so confused about F2A. It's current and my I-130 was
    approved on 8/12/13. its for my husband and he is outside the U.S. The PD is June 21, 2013
    what will happen next? I called NVC they didn't receive the case yet. If they didn't receive it until September 30 Does that mean we lost the chance? or he still able to get a visa without long waiting ?

    1. Hi Sarah, is your case for Pakistan like mine? Basically, in October the F2A category will have a date again, as long as your PD is earlier than their PD your process will freeze after NVC approves the case until that prior date passes your PD. Before in July of 2013 the date was Oct 11, 2011 so anyone who had a PD before that were getting interviews. My PD is April 3, 2012, thats why my wife was still waiting for her interview. NVC typically starts working on your case getting i-130 approved and then processing documents around 9 months before your PD is close to getting current. So unfortunately, if the Visa Bulletin PD goes back a few years you will have to wait for some time.

  63. Hello my priority date is 25th September 2012. My I-130 got approved on the 12th September 2013. It was sent to Department of State for visa processing on the 17th of September 2013. I am in category F2A, my dad is a green card holder who filed for me. Please help me figure out when to expect to get an interview and when my green card will be ready with the bulletin.
