USCIS Prediction For August To October 2013 Visa Bulletin

Department of State released their prediction for August to October 2013 Visa Bulletin. Please see details below: 

FAMILY-sponsored categories (potential monthly movement)

Worldwide dates:
  • F1: Up to five weeks
  • F2A: Could become “Current” at some point during the coming months.
  • F2B: Four to seven weeks
  • F3: Three to five weeks
  • F4: Three to five weeks

EMPLOYMENT-based categories (potential monthly movement)

Employment First:  Current 

Employment Second:

Worldwide:  Current

China:  Up to two months

India: At this time it appears that the availability of “otherwise unused” Employment Second preference numbers will allow for movement of this cut-off date in August and/or September. It is expected that such movement will generate heavy new applicant demand, primarily by those who are upgrading their status from the Employment Third preference category.  A sustained level of heavy demand could impact the cut-off date at some point during fiscal year 2014.


Employment Third:

 Worldwide:  No additional movement. This cut-off date has advanced 18 months during the past three months. Such rapid movement can be expected to generate a significant amount of new demand, with the impact not being felt for three to five months. Therefore, the cut-off date will be held until it can be determined what level of demand is to be expected, and whether it is likely to be sustained.

   China: No additional movement

   India: Up to three weeks

   Mexico: No additional movement

   Philippines: Up to two weeks

Employment Fourth: Current

Employment Fifth: Current 

Important Note: 

The above projections for the Family and Employment categories are for what is likely to happen during each of the next few months based on current applicant demand patterns.  Readers should never assume that recent trends in cut-off date movements are guaranteed for the future, or that “corrective” action will not be required at some point in an effort to maintain number use within the applicable annual limits.  The determination of the actual monthly cut-off dates is subject to fluctuations in applicant demand and a number of other variables.  Unless indicated, those categories with a “Current” projection will remain so for the foreseeable future.

  4. July 2013 VB is very baffling. what happened to all the spillover from other categories that all the sources were making references to. Can't understand EB3I is moving but not EB2. Does anyone get it?

    1. Yeah, I don't get it myself. I thought all unused EB visas would be dumped into EB2-I first, where every visa will be licked up due to a ruthless backlog in that category.

  5. Well my p.d is 8 June 2013 f4 visa .. according to this prediction it may be current in Comming 3 months... Can you plzz tell me the estimated month in which I will be scheduled an interview at the consulate if my p.d becomes current in maybe august or maybe even september ?

  7. It is probably difficult to say but is there really a significant change that EB3 ROW will retrogress to a date before 1/1/2009 (the 7/1/2013 cut-off date)? What happens if I file my adjustment the beginning of July and they retrogress the cut-off date to a date before my PD of 9/2008? Do they handle the cases based on when they receive them or based on the PD?

    1. EB3ROW could slightly retrogress in Sept VB (if demand is higher). Once I-485 is filed, USCIS will continue to process them based on receipt date.

    I would like to know PDs applied in which year(s) may become 'current' according to the following:

    F2A: Could become “Current” at some point during the coming months.

    According to July VB, PD of Oct-11 is current now. So, during August-October period, can we hope for PDs to move by 4 months in each bulletin or may be even faster?

    2. Thanks for the reply. Pardon my ignorance but does that mean applicants of all PDs from 2011 to 2013 could be granted green cards before the end of calendar year 2013? That would mean clearing MANY applications in a short time as per my understanding. Is this right? I am an f2a applicant from India, PD in 2012.

      Request you to please provide info or links that describe the procedure once PD becomes current, regarding any further docs to be submitted, how long will it take for gc to be issued etc.

    2 quick questions:
    1. Does this mean that F2A (for all countries and India) would move 2 years from 2011 to 2013 in 2 MONTHS and become current?
    2. If that does happen, will it stay current or is there a chance it could retrogress in Oct. or future visa bulletins?

  16. Even if the Aug/Sept VB gets the PD current for EB2I, there are less chances to get the GC (EAD/AP yes), if in Oct the dates retrogress ?

    1. Since the current processing time is 4-8 months (or more), USCIS might not be able to approve all NEW I-485 applications in just 2 months.

  22. Amazon, I was disappointed to see that there may be no movement in EB3 ROW for August to October. My priority date is April 01, 2009. My question is: based on the current outlook, when do you predict my priority date will become current? My concern is that my son will be turning 21 in Feb of 2013 and I am worried my priority date won't become current before then. Is there any chance that the predictions for next month can change? Please advise.

    2. Thanks for the update. You have enough time for PD to be current and I-485 application to be processed. We are currently calculating how far EB3 can move.

      There is a small chance of spillovers from EB2 category in Sept VB (which could make dates move forward). The blog post will be out in few days.

      I am also in the same situation - F2A India PD Sep 2012 and petitioner is LPR. Since I am not in the US, I believe the way to GC is through consular processing in my case. Would like to know more on that please.

      I have one more question - checked processing time archive for CSC and am quite baffled at what I saw. From Nov 2012 until April 2013, processing time is the SAME (Sep 3, 2011) for f2a category.Only in May 2013 has it moved forward, and that too very very marginal (it has moved to Sep 23, 2011). Can somebody please explain what does this mean?Is the CSC too slow in processing or does it mean there were hardly any f2a applications to be processed?

      Looking at the archive data of CSC has really pulled out the fizz generated in the last few days that f2a may get current very soon. I really hope there is nothing dreadful.

    5. It could also mean both: (a) CSC has a lot of different types of application to process (F1, F2A, etc) (b) There werent too many applications to process. Hence F2A category could be current in coming months.

      Thanks Amazon. Just gathered info regarding processing times at Vermont Service Center - it has jumped by almost 13 months to Feb 2012 after being stuck at Jan 2011 for a long time. I just hope CSC follows suit and help all who are eagerly waiting for f2a to get current :).

      My question now is - does NVC process our papers only after CSC displays a date that is past our PD?

    1. USCIS lists the latest processing time on their website (linked above). If there are no changes, they do not seem to update the last modified date.

    1. It means they are currently processing applicants with PD of Feb 2012. You will have to wait till it reaches Dec 2012. You can also try calling USCIS and open service request (thought they may ask you to wait till PD reaches Dec 2012).

  31. amazon ive read ur blog about visa wastage... poor thing... so many applicants for family based category, then still have visa wastage... they used allot those visas for fb applcants... one more thing why vermont servce cntr is feb 2012 already... and california is still sept 2011... 5 months diference? thanks

    1. The reason could be there are more cases in California service center compared to Vermont service center. A year back they did transfer case around to improve processing time.

    My category is F2A, my PD is June 2012. I am a Filipino but my wife addressed my petition she filed for me here in Spain where I live for 6 years now. What country of chargeability will reflect on my case, will it be the PD in the Philippines or Spain? Do these two countries have the same current priority dates? my wife already received noa2 but i haven't received mine yet. will i have the chance get a visa before the year ends? thank you.     1. Country of chargeability is typically your (or your wifes) country of birth/citizenship.

      If you or your wife citizenship is from Philippines, than your country of chargeability will be Philippines. Your country of residence is not important.

      You can also call your local NVC center (or USCIS) to find the current status of your F2A application. There is a link on right side of this page where you can also check your case status online.

  35. EB3 : My PD is August 2007, became current in May 2013 bulletin, due to illness filing of I-485 got delayed. Finally lawyers have filed this week. Question is if in the Aug 2013 bulletin PD's retrogresses, will my application still be considered. Does August 2013 bulletin go into effect as of 1st Aug 2013, of will I have a problem?

    1. USCIS first priority is to work on cases whose PD is current. If they have time, they also work on cases whose PD have retrogressed.

      August VB is effective from Aug 1.

  39. My parents are on a visit to us on visitor visa. I was checking their passport and found no I-94 attached in them and my dad's passport has allowed visa date while my mom's passport has only entry date. The officer perhaps missed to put allowed visa date. Now my questions are 1)why their passports do not have I-94? 2) Will there be any problem to mom leaving the country if no port visa is there? 3) Do I need to take care of it now?

    1. Hey you do not need to worry about it as long as you make sure they leave the country by the allowed visa date stamped on your dad's passport meanwhile apply for the I-94 for them, you will receive it in a 3 to 4 weeks period.

    Can you please tell when PD Feb.10,2003 will be current for INDIA? Your reply will sooth some pain of long wait. I tried your calculator it tells around august but the date did not move in august. One more thing I noticed your visa bulletin information for EB3-India tells 15Feb.,2003, while Govt. VB tells Ja.22,2003. why this mistake.

  47. My 485 AOS was filed a couple of weeks ago. There is a possible job offer from another company that I would like to move to... is my status transferable at time? If I do move to the new company would they have sponsor me again and refile from the beginning? Also let's say I wait it out and stayed with my current employer .. when is the soonest I can switch jobs without jeopardizing my GC status or future citizenship?
