  • EB1, EB4, EB 5: Current

    You said for EB 2 India it is between feb and apr so is it till beginning of april or to the end...

    1. How far EB2 India moves depends on (a) amount of spillovers from EB categories (b) rate of porting from EB3.

      Both of these can easily make dates move forward (or backward) by few months. Current estimate is Apr 15. This can easily change between Aug 1 and Aug 8.

    My PD is Sep 15, 2008 (EB2 India). Any chances for that to be current this year. Based on your analysis for 2014 Fiscal year demand data.
    I am planning to change jobs in September and restart my filing and be ready for next July. Any suggestions.

    Hi

    My PD is Mar 7 2008 - NSC. I will be travelling out of country from Aug 8 - Aug 22. Not sure if this date would be current in Sep 2013, if any RFE will be issued between Aug 8 - 22. Most of the RFEs seem to be EVL related. If it is EVL type of RFE, I assume i can submit the response during Aug 8 - 22. Can you please advise what things i should be taking care for the Aug 8 - 22 window when i will be out of the country.

    1. I am guessing you are EB2 India. If you have a company lawyer, the RFE notice will go to them. They can respond back to RFE. You can also ask them to contact you.

      Yes, there is a company lawyer and the G28 is signed. In this case, what are the possibilities that the RFE is physically mailed to my home address and lawyer not getting a copy of it. I just want to make sure the RFE is not sitting in my mailbox when i am out of the country during Aug.

    I am eb3 India with pd April 25 2007 ,my question is I was born on may 20th 1965 but my birth was not registered,I have tried to get a NABC from the concerned department but they are not issuing ,I have made an affidavit by my mother and uncle.is that ok.my school leaving certificate and passport shows the birthdate.please help to clear my doubts .

    11. Hi Sabir,

      Congratulations, Please discuss this with your lawyer to make sure the green card was issued correctly and not in error since your priority date was not current. USCIS can revoke your green card if they find out in the future even if it is completely their fault. You will be restored to I485 pending status and would not be able to work until you apply for new EAD. Your dependant's visa status could also be an issue. Talk to a reputed lawyer to see whats the best approach on whether to keep the green card or return the green card since your date of May 2008 might become current next month. See the articles of others who are facing similar situation.

    14. i had another priority date in Aug 2006 for which the GC got approved .. Sorry guys and checked with my attorney she said everything looks good.

    15. ok so both were false alarms. one basically sabir didn't check his PD as he has Aug 2006 PD and for the other person with June PD the USCIS was showed his PD as sep 2007 hence it was approved ,so don't know if there will be huge movement until June.Would be happy if it happens but now it looks like both were false alarms.

  15. My priority date is 7Jan2008 EB2 India. Unfortunately, I missed to file 485 when mine got current last time. My Spouse is suffering is h1b issues. In August we just missed for 6 days only. I really wich it should move so we can get EAD at least.

    1. Bleak this year. I would think Sept bulletin should go up to Aug 2008..level with China..After that, there may be movement for both EB2I and EB2C

  21. My PD is Nov 2004 EB2 - I, TSC. I got an approval email y'day. Physical card should be arriving tomorrow.
    I would like to congratulate Sabir but I firmly believe there is either a mistake from USCIS or from Sabir..How can a May 2008 PD's green card be cleared..That too even before mine. My case was filed in July 2007. I had ported from EB3 to EB2 in Nov 2012 and was waiting for my dates to become current since they were stuck @ Sept 2004. Of course, I know USCIS has done crazy things before, but this looks too good to be true..

  22. Just heard that the person who got approved with June 08 EB2I was issued the card in error(USCIS error) as PD said it is sep 2007 when his PD was june 15 2008.

    looks like USCIS bungled up.

    My wife is in Pakistan and her PD is Jan 30th 2013. I understand that PD is current for applicants living in US (Change of status).

    Do you think all this processing will some how affect international applications also?

    1. Yeah, the demand in some categories were MUCH lower than everyone (including USCIS/DOS) anticipated. They mentioned this in Sept VB.

      Since Sept VB is the last VB of the month, dates can sometimes swing wildly either forward or backward (based on actual demand).

      As you know USCIS does not release data on actual demand by category/country. It is an estimate based on 2-3 months old data.

  36. Hi! Amazon,

    I have a question,last sept 6 my us employer informed me thru email that my H1-B petition was successfull and they received the approved petition by mail,Then after 3 days, they emailed me again ,saying that they are waiting for some necessary information from USCIS before they can provide me a start date and send to me the approved visa.They didn't mention specific documents that they need from or any discrepancies particularly.My question is how long again will it take to gain my H1-B?Do will take again another FY?hoping for your advised.TYVM

    1. It could take some weeks or months (depending on what they are waiting for). I would recommend talking to your company lawyer. They would be able to give a much better timeline.

    i hope you could shed light on some of my inquiries,My sponsor for H1B told me that the USCIS is requested for some of additional information.When i checked my case status update thru online.i found out that the status of my case is request for additional evidence response review and my sponsor provided already the documents needed.what is the possible cause for the RFE? How it will affect the decision?is it vital? or just a supporting documents only? I hope you could give me some notes on this matter.Thank you very much
