If you have not done it, please remember to add or update your I-130/NVC/I-140/I-485 case in the Free GC tracker: http://www.mygcvisa.com/ tracker/

It would be very useful to understand how USCIS is currently processing these cases. It would also help in estimating date movements in future visa bulletin.

We will update this table as we get more data from USCIS. If you are interested, the dates above are based on following data:
  • Latest I-130/I-140/I-485 Processing Statistics (see link on right side) -->

Similar to EB3 category movement, we have added a blog post for EB2 category forward movement. Please click here for FB category.

Next Steps: If priority date is current and

1. If applicant is inside US, they will have to file I-485: http://blog.mygcvisa.com/2013/04/how-to-file-i-485-application.html

2. If applicant is outside US, it will be sent to NVC: http://blog.mygcvisa.com/2013/09/nvc-consular-processing-steps.html

  12. Hi Everyone, My dad has sponsored my sister (F2A). He doesn't have income and has not filed a tax return. I've to support my sister on the behalf of my dad. So, which affidavit form do I need to fill out? Also, what are the civil documents I've to submit to NVC. I just paid fees today.

Thank you all in advance for your help.

    1. Even if he has not filed taxes he needs to fill out an i-864 and you need to do that aswell. He needs to attach a letter explaining that he has had no job for the past 3 years meaning he didn't have to file. The civil documents that you have to send are all listed in the welcome letter.

      Delete
    2. Alejandra, looks like I've to file i-864 a. Does my wife have to file one since we have filed joint returns for 2014?

      Delete
    3. I am afraid I don't have enough information to accurately answer your question. Are you the petitioner? Or a household member? Is your wife either of the two?

      Delete
    4. I'm the householder member. My dad is a petitioner who doesn't have income. My sister is an intending immigrant(beneficiary). Since my dad doesn't have enough income, i have to help him. My wife and I have filed joint return. I'm wondering if she also has to fill out the i-864a since we file joint return.

      Delete
    5. So your dad lives with you? If he does then yes you file as a household member (i-864a) but if your income is enough then your wife doesn't need to file as well. Where it asks for past year incomes you write the total amount shown in tax return but when it asks for individual income, you will only use yours and that is what will count. If your income alone is not enough then she would file i-864a as well.

      Delete
    6. Alejandra, Thank you. I do have enough income, but we (me and my wife) filed tax as a joint return in 2014. Does it matter we have a joint return? Can I still do alone while we have joint returns?

      Delete
    7. As far as I know it doesn't matter if you filed jointly, you are only using your income. But like I said, when it asks for past year tax return amount write the combined number, but when it asks for annual individual income, you write yours only. You are the only one filing i-864a.

    8. Alejandra, Thank you. My dad is currently not in U.S, he is outside of U.S with travel document. I'm sending all the document stating his current address is with my address (while he was here he lived with me, and once he comes back he will live with me). Does he have to be here before we send the civil document? Again thank you for your help!

      Delete
    9. He doesn't have to be here when you send the documents as long as he doesn't stay outside of the U.S. for too long getting his permanent residence revoked. If he has proof that his main residence is in the U.S., he should have no problem.

      Delete
    10. Alejandra, I appreciate your in each and every question I've. He is out side of U.S with travel document which is valid for two years and he has been out of U.S for exactly a year. What would be the proof of U.S residence?
      Thank you

    11. What comes to mind is that he is on the lease of your house or any US bank account he may have. Unfortunately I am out of my depth here, I do not know if the fact that he is outside of the United States will be a problem, maybe not since you are acting as a sponsor. I recommend you to start a new thread in the visa journey website, maybe more people will be able to assist there.
