USCIS recently updated the I-485 pending inventory. The only problem is the data is as of April 2, 2013 (nearly 50 days old).

We were hoping the data would be current so that it would include thousands of new cases filed in EB3 ROW categories since May 1; but it looks like we may have to wait for another three months to get that data.
This new data would definitely help in updating the GC calculator tool; though it might take few additional days to do in depth analysis.
Q. What is not included in I-485 pending inventory
A. I-485 pending inventory does not include (a) consular processing cases which is around 15% of total 140,000 visas allotted each year (b) if I-140 is approved but I-485 application is not filed, then it will also not appear in this inventory (c) I-485 applications which has already been approved.
If I-140 and I-485 is concurrently filed, then the applicant will not show up in inventory unless I-140 is approved.

Is it possible to tell us what does it mean for EB3-ROW ?
ReplyDeleteAs expected the demand is much lower in EB3ROW (from 12,283 to 7,330). Since this inventory is more than 50 days old, it is hard to give an accurate estimate.
DeleteHowever it is still likely that EB3ROW would move around 5-6 months in July VB.

ReplyDeleteHi Carmen, your PD would most likely be current this year (probably around September VB). This old data from USCIS is not very helpful in giving accurate estimates.
DeleteHopefully it is true that 2007 and 2008 have a much lower number of approved I-140 since it wasn't easy to show that there was nobody around who was willing and able to fulfill the position with all the unemployment during that stretch of time? Do you know more about that?
ReplyDeleteIt is generally not so simple. People can retain their older PD in their new application filing.
DeleteExample: If they had filed in 2007 and I-140 was approved. Then they left the company. Then they joined another company in 2010 (or 2012), they can still retain their 2007 PD according to USCIS memo.

ReplyDeleteThe latest inventory data shows few applications(12) filed with priority date > 2008. On April 02, the PD < 2008 for EB3 ROW. So how is this possible ?
