  1. There are different categories of I-485: Is PENDING that they are busy with these cases; PREADJUDICATED done and OK but no GC available; COMPLETED done and GC available; NEW RECEIPTS received but no action yet.

    1. New Receipts: USCIS have just received the application.

      Pending: USCIS have started processing the application.

      Pre-Adjudicated: USCIS have finished processing the application and is waiting for visa number. They can still issue RFE in this stage.

      Completed: USCIS have finished processing the case. They have either approved or denied the application.

  3. When filing a I-485 one of the things some attorney's want to have are W2's of the last few years and the last 2 or more payslips. Does it happen often that USCIS issues a RFE with a request to see this information (if you didn't file it immediately)? If this information is sent immediately when filing a I-485 does it happen that USCIS asks for the last payslips again if the I-485 processing time takes very long?

    1. GC is for future jobs. Hence pay stubs are not required documents when filing I-485 application. You can send paystubs later if USCIS issues a RFE for it.

My I-140(PROFESSIONAL CATEGORY) was send to Texas Service Center and will complete 4 months in June 6th 2013 but my priority date is November 18th 2008 because my case took too long on the Labor Department until be aprooved. How long do you think is the average time for this kind of case to be aprooved? The immigration site says that is around 4 months but some lawyers says that is taking much longer because now they have less people working on immigration department. I will be allowed to apply on my I-485 on July 2013 but I have to wait my I-140 be aprooved. Thanks in Advance!

    1. Since USCIS is fully funded by fees, there is no cut in USCIS. However it depends on other government agencies for some tasks which might slow down (due to cuts). Typically I-140 processing time is 4-6 months.

      If your I-140 is pending but PD is current in visa bulletin, you will be also able to apply for I-485 application.

My I-140(Multinational Executive or Manager) was send to Texas Service Center and will complete 11 months in June 09th 2013 and still appear on the immigration site as"initial revew"  How long do you think is the average time for this kind of case to be aprooved? Do you think that something wrong can be happening with my case?The immigration site says that the processing time  is around 4 months but my case is taking so much longer than that and I'm starting to get worry about it. I would love if you can help me with these questions.

    1. Since the I-140 is pending for longer than the typical processing time, I would suggest calling USCIS (phone number on right side of this page) and open a service request with USCIS. They typically review the application and respond back in 30 (or 60) days.

      At the time of opening the service request, the person will tell you how quickly then can respond back. Hope this helps.

  6. In case of I-140 is approved and my I-94 is pending because a applied an extension of L1. Can I apply for I-485 even still with a status pending?

    1. You can file your I-485 even if you have applied for extending L1 visa.

  7. Dear Amazon: I have filed a I-140 amendment due to a succesor of interest case. I filed I-485 concurrently and I have received a "receipt notice, dated sept 13, 2013". Can I now, upgrade the I-140 petition to premium processing service while it is pending? I could not do this in the first time because it is not allowed when you do concurrent filing. Thanks!

    1. Typically you can file I-140 premium processing anytime (even if it is concurrently filed with I-485). There are few exceptions that your company lawyer can help. Premium processing has an additional charge of $1225.

Dear Amazon: We are all aware that govt tasks are not being performed currently due to shutdown, but i read couple of posts where its mentioned that fee funded services are active, my I -140 has been pending for 26 months now. received a receipt no. in july 2011, i dont have any update yet and online it shows initial review, i am in my 6th yr. of H1 and my the extension is up in Nov. 2013, so i thought of going for premium but as soon as i decided i got the news abt govt shutdown. Now i am not sure what should i do? should I still go ahead and apply for premium or i read one of your responses to call USCIS service centre and they can put a request so forth. Would highly appreciate your response in regards to which path should i follow looking at the fact that my h1 ext is up on 5th nov 2013. Please advice! Thanks much in advance!
