Does this mean they will start trickling down to EB3 now that there are only 3 months left in the fiscal year? DeleteEB spillover rules are little different. The flow is EB4 + EB5 --> EB1 --> EB2 --> EB3
When the spillover reaches EB2 category, it would be first consumed by EB2 India. Once dates for EB2 India is same as EB2 China, then both EB2 India and China would consume spillover equally.
As along as all countries in EB2 is not current, EB3 category would not get any EB spillovers.
FB spillover rules are different and EB3 Philippines would get 361 extra visas this year. Please see this article for more details:

Oh man, this is just so sad. I checked the demand data for EB3-Philippines and it looks like there would still be an estimated 2800 cases left for EB3-Phil once they allocate the 361 FB spillover and 233 visas per month for the remaining 3 months of the fiscal year. Does this mean that those with PDs of 2007 will never get anything at all for fiscal year 2014 because they are only allocated 2800 EB3 visas?!? I thought each country was only limited to 7% of the 140,000 EB visas!
DeleteDemand data contains only preadjudicated (approved) cases. To get real demand look at the I-485 pending inventory. It would give you a more accurate idea.
DeleteHowever the pending inventory does not include consular processing (CP) cases (which is typically 15% of 140,000 total visas). So you will have to consider that too. To make it more interesting, CP cases are included in demand data.
Also the 7% per country is only when deciding the initial VB cutoff dates (and for FB spillovers). It does not apply to EB spillover. The rules are different.
Hopefully this is not confusing. There are many things to look at to get an accurate picture and many data released by USCIS is few months old. This directly affect future estimates for many countries.
Man, this just keeps getting worse and worse. Just based on your best judgment and assessment, when will those with January-March 2007 EB3-Phil PDs become current?

DeleteIf all other countries in EB2 (EB2 ROW) are current and do not need visas, then it would flow to most retrogressed country in EB2 (which is EB2 India).

EB3ROW is expected to reach 15FEB2009 in July VB. So you should be fine. It takes about 4-8 months to process the I-485 application. EAD is typically processed in around 3 months.

Adding a spouse: Yes. If you can get married and add her as a dependent BEFORE the I-485 application is approved, it will be fine. If your I-485 is approved before she is added, then you will have to petition in the FB category.
Since you could be current in July/August VB, you have two choices: (1) Get married (Congrats) and add her as dependent (b) or you can postpone filing I-485 application.
You can file I-485 anytime as long as PD is current.

Hi W, Those are the average processing time given by USCIS to process I-485 application and make a decision. It could be shorter or longer than that (depending on each case).
DeleteIf I-485 is filed in Texas Service Center, then the average time is currently over 8 months.
Also there is an article on I485 processing statistics on right side of this page. That would give you an idea of how many pending applications are currently been processed by USCIS.

DeleteFrom EB3 ROW, all countries would get equal spillovers (upto max 7% per country limit). If these are still not used up, then it would go to the most retrogressed counties (India and Philippines, in that order).
In the second stage (above) when spillovers comes to India and Philippines, EB3 India would use up most (or all) of the spillover (since EB3 India is behind EB3 Philippines by many years).
Once EB3 India and EB3 Philippines have same dates, both countries would get equal share of spillovers.
We will have to wait for the demand data to estimate how much spillover will go to EB3 India and hence how far dates could move forward in last quarter for EB3 India.

Over the last few years we have seen rapid forward movement of the PD in the EB3 ROW category followed by a considerable step back. EB3 ROW has gone from cut-off date 7/1/2007 to 9/1/2008 in VB 4/1/13 and 5/1/13. Hopefully it will move even more just like you predict.
ReplyDeleteThe same happened between VB 4/1/2007 and 9/1/2007 and again between VB 2/1/2008 and 10/1/2009. There always seems to be a movement back to the last month were the more regular progress ended.
Based on the above is it possible that the cut-off date will go back to 7/1/2007 (VB 4/1/2013) which was the last month before the bigger jumps of 5/1 and 6/1/2013?

ReplyDeleteThank you for this information. My question is, over the past four months, the F4 category numbers have been stuck at May 1 2001. I have a PD of August 1 2001 under this category. Would you know why these numbers are stuck here? USCIS has asked us for all our documents which we provided a year ago. Also, when we filed the 485, I put my wife as a dependent. She is now filing under Employment Based 2nd category and she will include me in the application. If she includes my name in here application, will her green card and mine come out at the same time or will she then have to file another family based for me so that I go back to the F2A line?
1. The dates are not moving because the demand is currently more than the monthly quota from USCIS.
Delete2. If your wife includes you as dependent in EB2 category, you both will be typically be processed at the same time. She will not have to petition you again in family category.

It is possible for EB2 India to move that far in last quarter of FY 2013. USCIS does not send out any communication for pre-adjudicated cases. You can call them and ask them. Some L2 officer provide that information.

I petitioned my son as F2a status when he was 18 hi s priority date was Nov. 2010,USCIS sent him a notice to go to US embassy manila for interview and Medical exam on Feb. 2013.Everything was done till during his interview the consular officer told him he is over age and no longer qualified for F2Astatus and should be in F2B status,isn't that USCIS should update his status to F2B automatically before sending him a letter for interview?It's frustrating experience because we spent a lot of money for airfare,medical fees,time and effort...can I claim for a refund for all the expenses?what should I do?is there a reconsideration for his case?

You can change employers 180 days after your I-485 application is pending for 180 days or more. It does not matter if PD is current or not.
I know FB spill over rule, It gates equally distributed to each category . In that case

ReplyDeleteSince there is only few months remaining in FY 2013, USCIS is not likely to make EB3 ROW current in FY 2013.
DeleteThis could change in FY 2014. We will have to wait for updated numbers to calculate how much forward it could move.
I filed my EB2 I-485 in April 26, 2012. My PD is July 2009.
ReplyDeleteI got my renewed EAD too, with 2 years extenstion, last month.
Can we assume my case is pre-adjudicated as it crossed well, the normal processing time of 4 months? Now it has crossed almost 14 months.
If you see the pending invemtory of I485 dated 4/2/2013 - EB2 India - Total is 42,978 .....> All these are before May 2010(Current in April 2012).
If you see the demand data released on June 2013, EB2 India - Total is 42,925. So, mostly I can assume my case is preadjudicated.?
It is possible that it could be preadjudicated.
DeleteUSCIS first priority is to work on cases which are current. Once they have more time, they can process cases whose PD is not current and preadjudicate them.
Remember USCIS can still issue RFE for pradjudicated cases (if USCIS decides they want an updated document example employment letter).
My pd is 8 June 2001 for f4 visa ROW. According to u that's gonna be current in July.. my question on that regard is what happens once my pd becomes current ? Will the embassy contact me for an interview date ? Or will I have to contact them ? Usually how long is the gap b/w pd beginning current and the interview date ?

My EB2 India PD is sep 15 2010.I think it will take another 1 year to be current,so I am planning to go back to India for a year or so.Will there be any bad effect on my case or later can I come back when it's current and submit my documents? Thanks in advance.
ReplyDeleteAssuming you have not filed I-485 application (and dont have EAD/AP), you should be fine traveling to India on H1/H4 visa.

ReplyDeleteThis is very interesting question. Every year EB3 (and EB2 China) get 2802 visas per year. We currently do not know the demand in EB3 and EB2 China between 2008 and 2010.
DeleteIf the demand is high in EB3 China, it could take much longer.
If you port from EB3 to EB2, it would take about 6-9 months and cost USCIS fees (and any lawyers fees). Your case would be open in both EB3 and EB2.
So the biggest factor is the USCIS and lawyers fees. If you are ok with that, you could go ahead and por from EB3 to EB2.

DeleteAny predictions on EB3-I based on DD. If demand of EB3-WW is less than 500 then does it mean the remaining monthly quota can be used to advance EB3-I?
ReplyDeleteIf EB3ROW does not use up all quota (which is unlikely), other countries in EB3 category will receive all spillovers (upto 7% max per country). After that EB3 India will receive any remaining spillovers (till date is same as EB3 Phillippines).

DeleteMy priority date is Oct 2009 under EB3 India. My wife country of birth is UAE... If my priority date become current in July 2013 VB which is very unlikely, as you mentioned the dates will move 5 to 6 months not 13 months... :)

Yes, since EB3 India is backlogged, you should cross charge it under EB3 ROW category.

Any idea about the August VB? I believe they may even stop moving the dates for EB3 ROW from August.
Dates should remain the same in Aug VB. It could retrogress slightly in Sept VB if demand is much higher.
DeleteOnly in October 2013 VB, they will try to use the EB1 spillovers and so the EB2 will touch 1 January 2008 only at that time. This is my opinion
ReplyDeleteOctober VB is start of new fiscal year for USCIS. Hence they have to move dates before Oct so that visas are not wasted.
DeleteHi are you able to leave your job as soon as the I-485 is filed? Or do you have to wait until this process is finished? I plan to leave my employer as soon as I get my GC, but if I can leave anytime before that without losing the GC, I would gladly do so.

ReplyDeleteYou can file I-485 as long as PD is current. If PD retrogress, USCIS can still continue to process the application.
DeleteThere is no rule from USCIS that your last name should be same as your husband. They can be different.
July Bulletin dates have not moved for EB2. What an agony! End of Road ? will it move forward any by Oct?

DeleteRemember USCIS (at their discretion) can still issue RFE for preadjudicated cases. It depends on USCIS officer who is looking at the case.
