    3. We are waiting for updated data from USCIS. The current demand in I-485 for EB3ROW is only till Aug 2007. We do not know how much demand is between Aug 2007 and Apr 2011. Hence it would not be possible to currently give an estimate.

I applied under EB3 ROW, my PD is quite recent (June 2012) and I'm quite pleased to see the progress made over the past few months (between Feb 1st and May 1st: 3 months but 9 1/2 months of progress!). As of May 1st I still have to wait 5 years and 3 months but I hope it's going to be much faster.
    What do you think are reasonnable expectations? Do you think these 5y and 3m can become less than 4y?

    1. It is very hard to give an estimate for June 2012. There are many factors which affects visa bulletin movement and many of these changes every month.

  15. Hi Amazon, My PD is (EB3-ROW) November 3, 2008 and my H1 (6 years) expires on August 31, 2013. Do I have to extend my H1 when I become current in June-July and apply for AOS?

    1. Most likely you may have to. Once I-485 is submitted, it takes 4-8 months to process. EAD takes around 3 months.

      If you do not have EAD when H1 expires, you would be out of status.

      Also H1 extension is free for you (employers HAVE to pay for H1 application/renewals).

  16. Is it really possible that EB3-ROW would become current? I thought CO said they hated retrogression, which they would have to do ultimately, if they made that category current.

    1. Charles Oppenheim does not like retrogressing dates. He also does not like wasting valuable visa numbers each year - hence the large forward date movements in most EB3 categories (except Philippines and India).

      Retrogression for EB3 ROW is very likely in Oct 2013 VB if number of applicants received till Sept 2013 is more than visas available.

    2. Unfortunately, June bulletin is gone without a "Current" for EB3-ROW (still grateful though for Sept 8, 2008!!!). Any hope it might get current during the future summer months? Hoping to squeeze in, since my PD is on Dec 10, 2010. Thank you for any insight on this matter. Your blog has been very helpful!

    3. EB3ROW dates are unlikely to be current this fiscal year (which ends in September 2013). We are expecting around 5-6 months movement in the July VB.

    1. F4 India is moving around 1 week every month. It is current at May 2001. So it would be a long time to reach that date.

There are a ton of blogs out there from Immigration "Specialists" but rarely do you see one where sources have been cited. You are a solid statistician.     5. The bulletin is not yet released. The guy just mentioned that his PD is Jan 15, 2008, not the PD for EB3 ROW is Jan 15, 2008. Let's wait and see.

    2. If you call 202-663-1541 (the visa bulletin hotline), you'll notice they already took down the May bulletin and replaced it with a "Test 1 2 3" message. Probably means the new bulletin recording will be available very soon.

    1. The announcer in the 1/2 message references bulletin by number 5759... which is September 2012, but the numbers don't match the published bulletin for that date.

    1. You guys had your fun when the dates moved 3 years in 3 months and the whole world filed for I-485. Its us EB3 - ROWs turn to enjoy filing the I-485. :)

    3. EB2ROW is current and not retrogressed. The only countries which will be affected by EB3ROW porting to EB2 ROW would be EB2 India and EB2 China. The reason is EB2 China and EB2 India would get less spillovers from EB2ROW

  30. Can anybody give me a prediction for the July 2013 VB? Our PD is 9/17/2008, EB3 ROW. We are really close (cut-off date June 2013 EB3 ROW, PD 9/1/2008) and very afraid that the progress will stop now just like it did several years ago when the cut-of date went back again.

    3. Thanks Amazon for all the information. I checked the USCIS website and at this point of time the Texas Serviced Center shows 8/28/2012, the Vermont Service Center shows 9/19/2011, the California Service Center shows 4/11/2011 and the Nebraska Service Center shows 4 months for I-485 processing. The latest processing time information on the USCIS website seems to be from 2/28/2013, but the same page states:

      "The charts are updated on or about the 15th day of each month."

      How is it possible that the differences are so big per Service Center (do Vermont and California only handle the difficult cases?). And why are the processing times not updated if they are suppose to do this "on or about the 15th day of each month".

    4. EB categories are typically processed at TSC and NSC.

      One possible explanation for big difference in processing time is how many people are available to process the application. Some service centers have more employees (and contractors) than other service centers. Other reason could be one service center have more cases to process.

      Based on latest I-485 processing statistics, the workload seems to be equally distributed.

      There could be three reasons why times are not updated around 15 of each month
      (1) They do update data but forgot to change the "last updated date"
      (2) There is no change in processing time since they last updated it few months back
      (3) They did not have the time to update the dates.

      Scenario 2 is most likely. If the volume of I-485 applications increases (which is likely), the processing time could increase in next quarter.

Finaly, what hapens if the employer who had petitioned your imigration hapens to hav given up on u due to the retrogresion, what options do i hav n what r the odds???

    1. I am guessing you are EB3 ROW. Based on data, we are expecting EB3 ROW to move around 5-6 months in July VB.

      A good employer should care about the work you are doing and not your visa status. Unless they are small company and worried about H1. You do have an option of changing employers. Though it might mean starting the process again, though you can typically retain your I-140 priority date.

      I would recommend waiting few more weeks for July VB to be released.

    1. You can extend your H1 indefinitely as long as I-140 is approved and I485 application is pending. In this case it would typically be extended for 3 years.

    What are the chances of the EB3 ROW going into retrogression in the months coming ahead? My priority date is end of OCT, 2008. In case it gets retrogressed what could be the projected movement going forward. Just want to know if my date becomes current in July 2013 VB how long will it take me to get the GC.

    1. That is a very good question. We will have to wait for updated I-485 pending inventory to get an accurate estimate. The current data is around 4 months old.

    As you mentioned, with the July bulletin the EB3 ROW date might move 5-6 months. I have noticed the same prediction for EB3 ROW on other formus as well. You also mentioned the recent I-485 ineventory and demand data are not out yet. I want to know what basis are you predicting it? FYI- I'm new to all these terms like demand data, pending 485 inventory etc.

    1. There are many factors which affects visa bulletin movement. Since you are new to all this, I would recommend reading articles on right side of this page (analysis of demand data, FAQ: I-485 pending inventory, EB3 ROW future date movement, etc). It would give you a good idea how future VB dates are calculated.

    1. The PD has to be BEFORE the visa bulletin dates to be current. Since VB date is 8 june 2011 and your PD is not before that (it is same as that), you would have to wait for July VB to be current.

      You can also call up the US Embassy to check on the interview letter.
